The 2d of Aprill .1655:- [CENTRE HEADING]
Examined upon the said Libell/:
4us/
Juan de Sanpelayo of Mallega in Spaine Merchant
aged 48. yeares or thereabouts a Wittnesse sworne and
examined saith and deposeth as followeth videlicet./
To the first and second articles of the said Libell hee saith, That hee this deponent
knoweth not nor can depose any thing as to the name of the Master, or
shipp or proprietie lilate, neither knoweth hee any thing of the time of the
arrivall of the shipp lilate. And therefore saving his subsequent deposition to
which hee referreth himselfe hee saith hee cannot depose./
To the third hee saith, That in or about the yeares 1651. last past some procee
dings being had in the Court of the Royall Admiraltie of the Port of Mallega
in Spaine by the fiscall of that Court against the producent ffrancisco Lorenzo
de Lara for and concerning the goeing away of a certaine English shipp out of
that Port without Licence, and contrarrie to security entred into by the said
producent, and the said Cause having by the fiscall of that place been appealed
to the high Court at Madrid, the said producent was there condemned
and afterwards upon an execution issued out of the said high Court of
Madrid againt the person and goods of the said Lorenzo de Lar, by Vertue
whereof the said producent was personally apprehended, and his hoods seized
upon in order to the satisfaction or payment of Two Thousand ducketts forfeited
by the said Lorenzo de Lara as fidussor for the said English shipps not
departing from Mallega without due licence as aforesaid: And thereupon the
said ffrancisco Lorenzo de Lara by his adresses to the Viador or Judge of
the said place procured a respite of 6. moneths for the payment of the said [?summe]
or preventing, the payment thereof, if possible, but saith that by a second decree
from the said high Court of Madrid, the said producent was constrained
and did actually pay the said Two Thousand duckatts and for the use of
his Royall Majesties of Spaine as being forfeited upon the occasion aforesaid
and this deponent by the Councill of Warr of Mallega was ordered to receive the
said summe to the use aforesaid, being then thereunto entrusted by Don Pedro de [?XX]
Funes then Viador of that place by his Catholique Majestie And saith this deponent
then observed, by the bookes and records of the Registry of the said Viador
that the said Two Thousand duckatts were so ordered to be payd by
meanes of the breach of Contract of a Commannder of an English shipp
which some time before had without licence departed out of that port. And
further cannot depose, saving the said 2000. duckats were payd to the [?Corruridor] and Judge of
the Contraband goods at Mallega, who succeeded the said don Pedro de Funes in the said office of [?Veedor]
To the 4th and 5th hee saith hee knoweth nothing thereof:
To the 6th hee referreth himselfe to the Law, And further cannot depose
To the 7th hee saith hee referreth himselfe to the Acts and proceedings
of and in this Court and Cause And further cannot depose
To the 8th hee saith, his foregoeing deposition is true./

To the first Interrogatorie hee saith, That hee cometh to bee a Wittnesse
and to declare the trueth of his knowledge in this Cause at the
