at the tyme of seizure was and att present is the true and Lawful Owner and
proprietor of the sayd sylver moneys and goods allegat this deponent having
seene them all in the quiet possession of the sayd producent and his ffactor
respectively as aforesayd, and knowing that they were and are the proceed of
Linnen and often peice goods of fflanders which the sayd Michael Perry sold
in Spaine for his owne Accompt. And further saith that he saw the producent
lade the sayd Peru moneys aboard the Sampson, and barrs of sylver and Mexico
moneys aboard the Salvador to and for his owne Accompt and Risco to be from
Cadize transported in the sayd shipps respectively to Oostend whither the sayd
Shipps were bound, and there to be delivered to himselfe or his Assignes for his
Accompt. And further he cannot depose.

To the second, third fourth fifth and sixth Articles of the sayd allegation this
deponent saith and deposeth that after the aforesayd sylver plate and moneys
were laden as aforesayd he this deponent saw the Purser of the Sampson Pedro
Huckfeild or del Campo firme three bills of lading of one tenor for the sayd two
baggs of Peru money in his lodging in Cadize about the latter end of September
of beginning of October last past. And also about the same tyme saw the arlate
Christian Cloppenbergh Master of the Salvador in his lodging in Cadiz signe three bills of lading of
[one] [tenor] for the barr of sylver aforesayd and three bills of lading of [one]
[tenor] for the Mexico moneyes aforesayd, one of which sayd bills of ladeing
of [every] of the sayd three tenors respectively], videlicet one for the Peru moneys in the
Sampson, one for the barr of plate and one for the Mexico moneys aboard the shipp
Salvador were aboard the sayd shipps respectively att the tyme of seizure, And
saith that the three bills annexed to the allegation and now showne him being for the
sayd plate and moneys were and are three of the originall bills of lading which
this deponent saw firmed as aforesayd, and the same were as this deponent
beleiveth brought to this Citty by the sayd producent coming a Passenger in
the sayd shipp Salvador. And he further saith that he knoweth that the arlate
Nicholas Groote mentioned in the bill of lading for the moneys aboard the Sampson
was and is an Inhabitant of Antwerp, and a subiect of the King of Spaine
and a Correspondent of the producents in the way of trade to take and [receive]
goods of him. And moreover saith that whereas in the respective bills of
lading entry is made therein that the sayd sylver plate and moneys [are] for the
Accompt and Risco of Arnout van Haesdonck of Hamburgh, the truth is
that the same was and is colourable onely and done for this purpose the better
to preserve the sayd moneys and plates if the same [had] [bene] mett by the ffrench
shipps, which manner of colourable bills during the warres betwixt
ffrance and Spayne, and amity betwixt ffrance and Hamburgh hath bene
usuall with some Merchants driving a trade betweene Spaine a
fflanders, And saith that the producent did acquaint this deponent att Cadize
aforesayd that the sayd moneys and plate were really for his owne proper Accompt
and that he colourably made use of the name of the sayd Haesdonck for the end
and purpose aforesayd. And further to theis Articles materially, referring
himselfe to his forgoeing deposition and the Acts of this Court he cannot
depose saving he saith that by common repute the sayd Haesdonck is a merchant Inhabitant of Hamburgh
where this deponent saith he saw him about two yeares agoe.

To the seventh and eighth Articles he saith he saith that the arlate John de Laffly
[was] and is a Boatman or Barkman belonging to Saint Lucar where this deponent
hath knowne him for seven years now past or thereabouts. And saith that he
the sayd Laffly brought the sayd moneys plate sarsaparilla in his barke or
Boat from Saint Lucar, and carryed the sayd plate and moneys aboard the Sampson and Salvador
the producent being with him and lading them himselfe for his owne Accompt
albeit the sayd Laffly be named as lader in the bills of Lading. And saith that
noe subiect of the States of the united Provinces, ffrench king or of any
Prince or State in hostility with England had or hath any property or [interest]
in the money plate and goods now claymed in this Cause, And otherwise
referring himselfe to his former depositions he cannot depose
