Transcription

in the sayd 4th article mentioned being a bill of sale by him then made to the arlate
Thomas Sherwill in the sayd writing alsoe named and did thereby sell and sett
over to the sayd Sherwill the sayd shipp the ffrancis of Sunderland, being
(as the sayd writing declared) of the burthen of one hundred and twenty tonnes
or thereabouts with all her tackle furniture masts saysles sayle yards Anchors
Cables Roapes Cords boate Oares ordnance, gunns, gunnpowder shott
tackle and furniture whatsoever to her belonging for a valuable consideration
as the sayd writing declareth, which consideration was as this deponent
heard the sayd Simpson both before and at the ensealing of the sayd payment
writing or bill of sale by him made the summe of two hundred and fower
score pounds sterling, And hee this deponent well knoweth the sayd
parchment writeing in the sayd 4th article mentioned to be his this deponents
owne hand writeing and saith that all things in the sayd writing
conteyned were and are true (as hee beleeveth) and were, of this deponents knowledge soe had and done as in the same is sett
downe and expressed in the presence of this deponent and Isaack Knipe Edward
Kingman and ffrancis hudson whose names are subscribed as wittnesses
on the back of the sayd writeing or bill of sale and were by them soe subscribed in this deponents presence but whether Thomas Tapper
were present at the sealing and delivery of the sayd writing or subscribed the same
in this deponents presemce hee remembreth not And further to those articles
hee cannot depose./

To the 5th and 6th hee saith that by reason of the premisses hee beleeveth the sayd
Dherwill from the tyme of the sayd writing or bill of sale soe signed and
sealed was and is the true owner and proprietor of the sayd Shipp the ffrancis
of Sunderland her tackel apparrell and furniture and all things belonging to
her and that the sayd Sherwell ought to have the possession of her, and to
have the freight due for the hyre of her as true Owner thereof And
further to those articles hee cannot depose/

To the 7th and 8th articles hee saith hee cannot depose/

To the 9th hee saith hee referreth himselfe to the Registrie of this Court
and further hee cannot depose./

To the 10th hee saith hee cannot depose for that hee never knew the arlate
Sampson Nicholas./

To the 11th hee saith hee referreth himselfe to his foregoeing deposition
and to the lawe And further hee cannot depose/

To 12th hee saith his foregoeing deposition is true/
