The same day [CENTRE HEADING]

Examined upon the sayd libell./

Rp.

Thomas Tapper of the parish of Saint Thomas the Apostle London
Merchant aged 20 yeares or thereabouts a wittnes sworne and
examined saith and deposeth as followeth videlicet

To the first second third and 4th articles of the sayd libell and the writing in parchment in the sayd
4th article mentioned hee saiith that the arlate henry Sympson did in the moneth
of december 1653 take upon him to be the true and lawfull Owner and Pro=
prietor of the arlate shipp the ffrancis of Sunderland and of her tackle
Apparrell and furniture and did as Owner thereof in the sayd Moneth of december 1653
signe seale and deliver in the presence of this deponent and his contest Robert
Walpoole and the rest of the wittnesses whose names are thereto subscribed the
writeing in parchment mentioned in the sayd fowerth article of the sayd libell
being a bill of sale made by him the sayd henry Simpson to the arlate
Thomas Shirwill in the sayd writing alsoe named of the sayd shipp the
ffrancis of Sunderland and of all her masts sayles sayle yards Anchors
Cables Roapes Cords boate Oares Ordnance, gunns, gunpowder shott
tackle apparrell munition and furniture whatsoever to the sayd shipp
belonging, and this deponent gaving well viewed and perused the sayd
writing well knoweth that the subscription of Thomas Tapper on the back
side thereof was and is his this deponents owne hand writing and was
by him subscribed thereto (as the same now appeareth and is) at the tyme of
the signeing and sealeing of the sayd bill of sale of the sayd shipp by the
sayd henry Simpson, and well knoweth that all things in the sayd writing
or bill of sale conteyned were soe had and done as in the same is declared
and the sayd writing is the same bill of sale soe signed and sealed by the sayd
Simpson the day of the date thereof, And further to these articles hee
cannot depose./

To the 5th and 6th articles hee saith that hee verily beleeveth that the
sayd Thomas Sherwell ever since the sayd writing of bill of sale
predeposed of soe signed and sealed by the saud henry Simpson, (which was
done in december 1653 hath had and ought to have the sole right propriety
and interest in the sayd shipp the ffrancis of Sunderland and her
tackle Apparrell and furniture as alsoe in the freight due for her
for all the voyages shee hath made since the sayd sale of her soe made
by the sayd Simpson, and that noe other person hath any right in her or
her freight save the sayd Thomas Sherwell and further to these articles
hee cannot depose/

To the 7th and 8th hee saith hee cannot depose

To the 9th hee saith hee referreth himselfe to the Registrie of this
Court and further cannot depose./

To the 10th hee saith hee knoweth not the arlate Sampson Nicholason
and therefore cannot depose to this article/
