IN THE NAME OF GOD AMEN I Robert Dawes of Wootton under Edge in the County of Glostt. Clothier being weak in body but of sound perfect and a disposing mind memory and understanding thanks be given to God for the same knowing that it is appointed for all men to dye but the time being uncertaine doe make and ordaine this my last Will and Testament in manner and forme following

AND first I bequeath my soul into the hands of Allmighty God hoping assuredly through the merritts of Jesus Christ my only Saviour to be made partaker of Life everlasting And my body I Commit to the Earth from whence it came to be buried in Christian buriall in a decent manner at the discretion of my loveing wife and Executor hereafter named

And as for such worldly Estate in Lands and Goods as it hath please Allmighty God to blesse me withall in this Life I give devise and bequeath the same in manner and forme following

And first I give unto the poor housekeepers of the Towne and parish of Wotton under Edge wherein I now dwell the summe of twenty pounds of lawfull money

ITEM I give unto such Minister as my Executor shall procure to preach my ffunerall Sermon the summe of ffive pounds

ITEM Whereas I have steled on my virtuous and loving wife Lydia Dawes One Annuity or Rent Charge of Thirty pounds per annum during her life to be issuing and payable out of new Mills and the Lands thereunto belonging and being desirous my said wife shall release the said Annuity or Rent Charge of Thirty pounds per Annum and all her Estate and interest in and to the Messuages and Mill called New Mill and Lands thereunto belonging unto my sonne Thomas Dawes to whom I intend to give and devise the same And in liew and recompense whereof I give unto my said virtuous and loving wife the summe of Three hundred pounds of lawfull money upon Condition that she release the said Annuity or Rent Charge and all her Estate and interest in and to the said Messuages Mills and Lands within Three months after my decease the said Three hundred pounds to be paid at the same time as she shall release and surrender her Estate therein And incase she shall refuse to release or surrender the same as aforesaid Then the said bequest of Three hundred pounds to be void And my further Will is that my said wife shall hold and enjoy the house and premises wherein my sonne Thomas Dawes lately dwelt during her naturall life Also I give to my said wife the bed with its furniture now in the buttery Chamber

ITEM I give and devise unto my Grandsonn and Godson Robert Dawes sonn of my sonn Samuell Dawes the summe of ffive hundred pounds

of lawfull money to be deducted by his father out of the moneys he owes me

ITEM I give unto my daughter Elizabeth Byrten the summe of Eight hundred pounds of lawfull money to be paid her by my Executor within two years after my decease And I will that my Executor shall pay her interest for the same after the rate of ffour pounds per Cent till the same be paid.

ITEM I give unto my Granddaughter Elizabeth Byrten the sume of ffive hundred pounds of lawfull money to be paid unto her when she shall attaine the age of One and Twenty yeares And I will that my executor shall pay interest for the same after the rate of ffour pounds per cent untill the Same shall become due and payable But my further Will is that in case my said Grand daughter shall happen to dye before she shall attaine the age of One and Twenty yeares or be married then the said ffive hundred poundes given her shall be and come unto and amongst my four children Thomas Samuell Elizabeth and Esther equally to be divided amongst them to whom I give and devise the same

ITEM I give and devise unto the younger children of my said daughter Esther when she shall have more than one the summe of Two hundred pounds of lawfull money to be put out at interest by my Executor for their benefitt within two yeares after my decease and be paid unto them as he she or they shall attaine their severall ages of One and Twenty yeares or be married or which of them shall first happen by equall portions

ITEM I give unto Anne Tyler my daughter in law Twenty pounds if she shall live to attaine the full age of One and Twenty yeares

ITEM I give and devise unto my sonn Thomas Dawes the bedstead bedd bedding furniture vallances and all other the furniture of my best or new Chamber which I bought of William Wallington

ITEM I give unto my sonn Robert Dawes one good bed with its furniture And I give the ?Curaton and Guardianship of my said sonn Robert Dawes and of his Estate unto my daughter Esther and that she take the care and charge of him and his Estate and receive the xxxxx and profitts thereof for his maintenance and education

ITEM all other my bedds bedding furniture brasse pewter tablelinnen and leather chaires I give and devise unto my two daughters Elizabeth and Hesther to be equally devided between them

ITEM that in case by reason of some Losses I am likely to have my personall Estate will not rise to pay all my Legacies and Debts that then I give and devise all my messuages mills Lands Chattle Leases hereafter mentioned in this my Will unto my Executor for the terme of fforty veares to raise moneys for payment thereof

ITEM I give and devise unto my sonn Samuell Dawes after the payment of my debts and Legacies all that my Messuage ?Closes Lands and premises lyeing at Huntingford which I lately purchased of M:r Thomas ?Grayle Minister being ?atte parcell of Huntingford ffarmes To hold the same Messuage Lands and premises unto the said Samuell Dawes and his Assignes for and during the terme of his naturall Life And after his decease I give and devise the same unto my Grandsonn and Godsonne Robert Dawes sonn of the said Samuell Dawes his heires and Ass. Forever Neverthelesse charged for payment of my debts and Legacies as aforesaid

ITEM I give and devise unto my said sonn Thomas Dawes all that parcell of ffreehold Lands containning half an acre which lyeth in a ground called the Hawes in Bradley To hold the same to him his heires and Assignes for ev.

All those my Messuages Mills Lands and premises which I purchased of the Smythes called New Mills scituate and lying in Kingswood in the County of Wilts and Glouc. or one of them To hold the same Messuages Mills Lands and premises unto my said Sonn Thomas Dawes and the heires male of his body issuing And for want of such issue I give and devise the same unto my said Grandsonn Robert Dawes and the heires of his body And for want of such issue I give the same to my Sonn Sam: Dawes his heires and Assignes for ever

ITEM I give and devise unto my said sonn Thomas Dawes All those my ffive acres of arable lands lying within the parish of Wootton Underedge which I purchased of W:m Leigh To hold the same to him the said Thomas Dawes his heires and Assignes for ev. Neverthelesse so that all the said Messuages Mills Lands and premises aforesaid shall stand charged with the terme of fforty yeares for payment of my debts and Legacies

ITEM I give and devise unto my said Grandson Robert Dawes the house wherein my Sonn Thomas Dawes lately dwelt in Wootton Underedge To hold the said house and premises from and after my wifes death to him the said Robert Dawes his Executors and Assignes for and during all the residue of the Terme which shall be then to come and unexpired together with the Lease thereof

ITEM all other my Chattls Lease and Leasehold Estates scituate lyinga nd being within the parish of Wootton Underedge in the County of Glouc: I will that my sonn Thomas Dawes shall hold and enjoy the same and have receive and take the rents issues and profitts thereof to his own use during the terme of his naturall life And after his decease I will that his issue male shall hold and enjoy the same Chattls Leases Lease hold Estates during the residue of the severall Termes which shall be then to come and unexpired But in case my said sonn Thomas shall dye without Issue male Then I give the same Chattls Leases and Leasehold Estates from and after the death of my said sonn Thomas Dawes unto my said Sonn Samuell Dawes To hold the same to him the said Samuell Dawes his Executors Administrators and Assignes during the remainder of the severall termes and Estates as shall be then to come and unexpired together with the Leases thereof Neverthelesse chargeable with payment of my Legacies and debts

ITEM I give unto my said sonn Samuell Dawes my best silver Tankard marked X.S.D.

ITEM I give unto my servant John Luxx ffive pounds

ITEM all other my goods chattels and plate not herein before by me given and bequeathed after my debts and Legacies paid and ffunerall Expences discharged I give devise and bequeath the same unto my said sonn Thomas Dawes whom I make constitute and appoint whole and sole Executor of this my last Will and Testament And lastly I desire my loving kinsman M:r Samuell Trowman Minister and my loving friend John Xows Attorney at Law to be my Trustees and Overseers of this my last Will and Testament hoping that they will see the same duely and truly performed and to be assisting to my Executor touching the same and to each of them I give fforty shillings In witnesse whereof to this my last Will and Testament containing five sheets of paper to every sheet I have subscribed my name and to the last sheete have putt my seale the Thirtieth day of August Anno Dom 1693 and in the fifth yeare of the now majesties reigne

I ROBERT DAWES of Wootten Underedge in the County of Glouc: Clothier doe hereby republish ratify and conform my Will hereunto annexed as if the same was originally made this Eighteenth day of September Anno Dom 1693 but with these additions in this my Codicill expressed And I doe declare that my Lands devised in my Will shall not stand charged with payment of any Legacies in case my personall Estate will amount to pay the same

ITEM I give and devise unto my sonne Samuell Dawes the summe of fifteene hundred pounds of lawfull money to be by him deducted out of the debt or moneys that he doth owe unto me but not otherwise

ITEM I give unto my daughter Elizabeth Byrton a Selver plate

ITEM I give unto my daughter Esther ?Larton my best Silver Salt

ITEM I will that all my Tableboards Bedsteads Standards and puters now remaining in the house I dwell in shall be and remaine to my Executor notwithstanding and devise or words in my said Will to the contrary. Witnesse my hand the day and yeare abovesaid
