called out to Captaine Lucy for aide, who sent foure or five
of his men aboard, and at this deponents instance tooke
the Italian Captaine, boatswaine and two more Italians
out of the Nostra Signora into his shipp, namely such of
the Italian company as this deponent found mutinous and dangerous,
and this deponent having presented the said Captaine
Lucy with a Jarr of oile, a Jarr of [?TXXX] some anchova's and
other things, which hee kindly accepted, and soe they parted
this deponent with his shipp for ffalmouth, and the said Lucy
for halford whether hee prayed this deponent to send his men
that hee had [?XXX] [?him] to him, gratifying them for their paines
in helping to conduct this deponents shipp to ffalmouth, and
this deponent accordingly gave them three pounds in money
to neare their charges to their frigot; and otherwise the said
Lucy did not make any seizure of the said shipp, or pretended
ought upon her as prize.
Ad 9um arlum deponit that after the commong of the said shipp
Nostra Seniora with her lading into ffalmouth, the arlate
Collonel Tremaine came aboard and made seizure of her
in th ename of his Royal highnesse upon pretence of their
belonging to some of the Enemies of this Realme, whereof
when the said Lucy heard, hee sent againe and seized
her, saying (as this deponent heard) that if shee would be prize
to the duke shee would be prize to him, for his men had bin first
aboard her. And saith that the said Collonels Officers and
Lucie or his men broke open her hatches, as this deponent
(who was then come for London) heard and embargoes her goods
as is arlate, such detention and embargolment hee saith are
to the very greate dammage of the said Alderman ffoote and
the said other Merchants proprietors by losse of market and otherwise
to the valew (as hee beleeveth) of two thousand pounds
and upwards. And saith that the said Collonel Tremaine before
hee would lett the said shipp come away (though shee was ordered to
be brought about) demannded and received of and from this
deponent (who went to fetch her up) twenty one pounds,
besides hee saith there were other charges to other persons there
amounting to fourtie pounds more, which this deponent
disbursed. Et alr nescit.

Ad primum rendet that hee is a Mariner and hath
noe relation (otherwise then by being sopracargo as aforesaid of the said shipp)
to the said parties, nor is of kinn to any of them, alr salve ffecit supra.
Ad secundum rendet that there was noe such dutchman aboard or of the
Company that was a subiect of the United Netherlands, nor any other
than the said hamburger dutchman, and saith their voyage was to be
from Venice for Gallipoli and Zant and soe to London and back to Venice
which was the whole designe, nor were there more than two ffrenchmen
aboard
