Merchant against the shipp Saint Mary and}
against Marcus de la Rambida.}

Examined upon the libell given in
on the behalfe of the said Mr Antonio
ffernandez.

Abraham Rutter of London Merchant aged 30 yeares
or thereabouts sworne and examined.

To the first article hee saith and deposeth that from the yeere 1640
to the yeere 1652 hee this deponent was keeper of the
bookes and accompts of the producent Antonio ffernandez Caravajall
in the affaires and matters of his merchandize, and thereby knoweth that
the arlate Alonzo da Silva and domingo de S[?XXXXXlea] were
correspondents of the arlate Marcus da la Rumbida, who hee saith
then corresponded with the said prodcent, and gave him order for
sending severall goods to them for the accompt of him the said Marcus
de la Rumbida.

To the second article hee saith and deposeth that within the said time
mentioned in the said article the said Marcus da la Rumbida being
a Spaniard, gave order and direction unto the said Mr ffernandez living
here in London to send over into Spaine for his the said da Rumbida's
use and accompt unto the said Alonso da Sierra, all the goods wares
and merchandizes mentioned in the first schedule annexed to the said libell
and by him this deponent seene and perused, and alsoe gave him
order for the sending into Spaine for his the said da Rumbida's accompt
the goods mentioned in the second schedule libellate, and the said Marcus
da la Rumbida hath by his letters acknowledged the sending of the said goods
into Spaine, and the receipt of them there accordingly, which hee knoweth
for the reasons aforesaid being book keeper of the said Mr ffernandez
and thereby seeing and perusing his letters and dispatches in his merchandizing
affaires. And otherwise cannot depose.

To the third fourth and fifth articles hee saith and deposeth that within
the said time libellate the said Mr ffernandez and his servants and
agents bought and provided all and singular the said goods and
merchandizes mentioned and expressed in the said first and second schedules
and paid for the same the severalland respective summes
mentioned and expressed in the said schedules, which hee knoweth for
the reasons aforesaid, and hee beleeveth they were truely and really
worth and would have yeelded those summes, according to the then
currant and market price of the like commodities in and about this
citie of London, and that hee paid and satisfied for the dying, custome, packing
and other charges and expenses in and about the same, mentioned
to be there for paid and expended in the said schedules, which hee
deposeth for the reasons aforesaid And otherwise hee cannot depose.

To the sixth article hee deposeth that within the said time and
after the said buying and providing the said goods hee the said ffernandez
sent
