The 4th of October 1655/ [CENTRE HEADING]

Luson and others ffishermen of ffeversham against}
Arkenstall and others ffishermen of Milton et cetera}
ffrancklin Smith}

Examined upon an allegation given in the Acts of
Court in behalfe of the ffishermen of Milton and
places adiacent the 26th of SDeptember 1655/

Thomas Dylight of Milton in the County of Kent
ffishermen where hee hath lived from his byrth, there
borne aged 52 yeares or thereabouts a wittnes
sworne and examined saith and deposeth as followeth videlicet

To the sayd allegation hee saith that hee hath bin a fisherman for these
one or two and thirty yeares last and during all or the greatest part of the sayd
tyme videlicet for these 28 yeares last hee hath well knowne the places allegate
called East Swale and harty shoare and knoweth that
they are within the ebbing and flowing of the sea and that [?at ?the ?same]
at lowe water is about 7 pr 8 foote deepe and at some neape tydes
deeper at lowe water, but saith at high water or at three quarters
fludd shipps of three or fower hundred tonne burthen may and doe
passe in and out, And saith the same is commonly accompted t bee an
arme of the sea and part thereof and Common for all fishermen to fish in for oysters and other ffish And hee saith that hee wekk remem=
breth that one William Yonge a ffisherman of Milton did while this
deponent was his servant fish for oysters and alsoe for spratts and
herrings on the sayd grounds quietly and without any interruption that this deponent
knoweth of or remembreth, and saith hee beleeveth the sayd places
are and ought to be Common for all fishermen to fish in for oysters
and other fish, and hee this deponent well remembreth that about sixe
or eight yeares since hee did fish upon harty shoare for oysters
and being layd aboard and interrupted by one John hunt and John Gateman fisherman of ffeversham and others (who came armed with swords and musketts to that purpose) did take out a writt out of
this Court and by authority thereof cause the sayd John Gateman to
be arrested, and the sayd Gateman thereupon did compound with
this deponent and acknowledge that hee had done him iniurie in soe
hindering him of fishing in the sayd grounds and did pay this
deponents charges of the arrest and gave this deponent a summe of
money for compensation to lett fall the sayd action, which was tenn
shillings at least And saith that hee this deponent hath
often within these twenty yeares last past quietly fished for oysters
and other fish in East Swale allegate without any disturbance by any
the ffishermen of ffeversham, and hee beleeveth any ffishermen may
fish in the sayd East Swale for any fish whatsoever as being a place
common to all fishermen And further to this allegation hee cannot
depose./
