found driving in manner aforesayd for that hee observed shee had
received some smale shott which stuck in her sides and alsoe had receaved two or three
greate shott under water and for that her yards and tackle were cut downe
and her sayles plundered and her companyes chests staved and plundered
before shee was found driving as aforesayd And further to this
Interrogatorie hee cannot depose/

Examined upon the sayd Interrogatories

John Lambert of Wapping in the parish of Whitechappell and
County of Middlesex Mariner Commander of the Shipp the Lyon
in the imediate service of this Commonwealth aged sixty
yeares or thereabouts a witnesse sworne and examined
saith and deposeth as followeth videlicet./

To the first and second Interrogatorie hee saith that this deponent being then Comming homewards
from the West Indies hee and his Company of the Lyon found the shipp
Interrogate the nyne and twentieth day of August last about twenty or thirty leagues to the West of the Lizard pointe
and saith the shipp Interrogate was bought into Dartmouth
by some of the Company belonging to sayd shipp the Lyon And
saith the Shipp Interrogate was with much difficulty and by the care and
industrie of this deponent and his company of the Lyon aforesayd preserved from
perishing and brought safe to Brixham first and afterwards to Dartmouth in manner
following videlicet when this deponent and his company of the Lyon first
discerned the shipp Interrogate at a great distance there were fower other
shipps in her company whereof one of them runne on board of her,
but before this deponent and his company of the Lyon could get up to them all
the sayd fower shipps left the shipps Interrogate, and made away, And when
this deponent and company with the shipp the Lyon drew neere the shipp Interrogate
hee this deponent commanded his lieutenant John Gough with the Masters
Mate of the Lyon and other seamen of the Lyon to goe on board the Shipp Interrogate,
who at their coming aboard her found noe living man woman or boy
on board her nor other living thinge but three dogs or thereabouts and found that shee had received some shott under water
and that much water had gotten into her hold whereupon the sayd Gough and
masters mates and Company of the Lyon which this deponent soe commanded aboard her
returned all on board the Lyon and brought two sayles videlicet and the sprit sayle topp sayle of the shipp Interrogate and a smale kettle and a copper and a and told this deponent shee was in such a
condition that she could not be saved from sinking whereupon hee this
deponent tooke a boate belonging to the Marigold a shipp in company of the Lyon and commanded the Carpenter of the Lyon and some of his men
some mariners of the Lyons Company to goe with this deponant aboard the
shipp Interrogate and carried the ssaid two sayles againe on board the shipp Interrogate and whatever else brought out of her and this deponent coming aboard her found that
shee was in a very sinking and perishable condition, which notwithstanding
this deponent being desirous shee should be preserved if possible
caused as much as for the present might be to be done by his sayd
