Transcription

cut the Exeter Merchants hawser loose from his sayd Cable after the
same had continued fastned there to allmost an howers space, and by
that meanes turned the Exeter Merchant and her sayd ladeing on drift
to the great hazard and danger thereof, which the sayd Woodfin being aboard
the ffrancis and mary perceiving, leaped from on board her, and came on board
his shipp the Exeteer Merchant, and the better to prevent all danger
that might ensue by her being cut loose, did cause an Anchor to bee
dropped, and vered the Cable, and used all other diligence hee could to prevent
any damage either to his owne shipp and ladeing or wany other lying neere,
but by reason of the sayd Smith cut her loose and turned her soe on drift
when the tyde of Ebbe ranne stronge, and that other shipps laye a smale
distance off, (notwithstanding his endeavoursm the force of the tyde
of ebb forced the Exeter Merchant fowle of the Pilgrim who late a sterne
of her and neere unto her, and by that meanes the Exeter Merchant brake
downe her owne quarter and brake and lost her aunchient staffe and receaved
other damage by falling fowle of the Pilgrims Boltspritt, and by
force of the sayd tyde was friven on ground with her ladeing
togeather with the Pilgrim and an other shipp lying then by the Pilgrims
side The premisses hee deposeth being on board the Exeter Marchant and an eye wittnesse thereof and further to these articles hee cannot depose saving
hisforegoeing deposition

To the 5th hee saith hee beleeveth that by reason of the sayd Smiths
cutting the Exeter Merchant on drift as aforesayd, the damage by him predeposed of
done to her quarter and the new mooreing of her could not but cost her Owners
a considerable summe of money videlicet at the least 30 li sterling as this deponent beleeveth And further
to this article hee cannot depose./

To the 6th hee saith hee referreth himselfe to the Registry of this Court
and further cannot depose/

To the 7th hee saith that the damage predeposed which happened to the Exeter Merchant
(and the Pilgrims damage if any bee) which hee knoweth not, did happen meerely bny
the sayd Smiths wilfull cutting the hawser of the Exeter Merchant, and turning her on drift,
and hee vverily beleeveth had not the sayd hauser bin cutt and shee turned on drift
noe damage had happened to the Exeter Merchant or to her ladeing or to any other
shipp neere her And further hee cannot depose/

To the 8th hee saith hee refereth him selfe to the Registry of this Court
and cannot further depose/

To the last hee saith his foregoeing depositon is true/

To the Interrogatories/ [CENTRE HEADING]

To the first hee saith hee was none of the Company of the Exeter Merchant
but was only hyred as aforesayd to bring her up from Blackwall And
further hee cannot answere/

To the 2 hee saith hee was present on board the Exeter Merchant the tyme Interrogated
and saith the premisses predeposed of happened in the afternoone and saith there
were present beside the Company of the Exeter Merchant this deponent
and one William Gage a waterman and an other waterman whose name hee knoweth not who were alsoe
on board her and hyred as this deponent was to bring her up from Blackwall
And further hee cannot answere/

To the third hee saith hee is about 42 yeares of age and hath bin a
waterman
