the arlate Shipp the Pilgrim with the Merchandizes of wyne and oyles predeposed
of on board her, laye at Anchor neere Dirke shoare arlate in a safe and convenient place
where shipps use to ride And hee saith that in the sayd Moneth of May and
whilst the Pilgrim roade there safe at Anchor the arlate Shipp the Exeter
Marchant (whereof the arlate Thomas Woodfin is reputed Master) did
fall fowle of the Pilgrim aforesayd and her ladeing and brake the Pilgrims
head and bolspritt and both her cables and by the violence of such her
falling fowle drove the Pilgrim on ground and (the Pilgrim being heavie laden)
did thereby much wringe her soe that some of her ?trunnells started, by meanes
whereof and by the Ex?i/eter
Merchant falling fowle of her the Pilgrim divers of the Caske wherein the oyles and
wines belonging to the sayd Bathurst Clarke and Baker were, ?now/were soe
crushed and bruised that they became very leakie, and leaked out a great
quantitie of the oyle and wyne that was in them, in soe much [OR ONE WORD?] that the Pilgrims
Company soone after the disaster arlate having gotten their sayd shipp on
floate againe and well moored, did sett their pumpe to worke the better to discover what damage
was done by the meanes aforesayd and to cleere the shipp from water,
and thereby found that the sayd Caske had received damage and that
much oyle and wine was leaked out of them, and was pumped up in great
abundance soe that a whole butt of oyle was pumped at the first
tyme of pumping after the sayd disaster, besides what ?came
up at the pumpe mixed with water and soe could not be saved, and saith that
allwaies after the sayd shipp Pilgrim was soe runne on ground, there came
up oyle at the pumpe every tyme the pumpe was used, (which was
divers tymes) and wine alsoe as he beleeveth though it were not soe easie to
be discovred amongst the water as the oyle was, this hee deposeth being
Masters mate and on board and an eye witnesse And further saving this
subsequent deposition hee cannot depose saving hee saith the sayd Exeter 'Marchant
fell fowle of the Pilgrim and runne her on ground and damaged her as aforesayd

To the 5th article hee saith That by reason of the damage and hurt predeposed
occasioned by the meanes aforesayd there were leaked out ?twelve
butts of oyle ?X whereof as ?hereafter is ?declared were ?saved of the pumpe and two butts of Spanish wine, the wines belonging to the sayd
Baker, and the sayd Oyles to the sayd Bathurst and Clarke, but how many
of the butts of oyle leaked out. belonged to the sayd Bathurst, and how many of them
to the sayd Clarke hee cannot distinguish, but knoweth there were soe many leaked
out which belonged to those two persons but what the sayd oyles or wynes were worth a butt
hee knoweth not

sayd Caskes out of which the sayd oyle and wyne was leaked were surveyed by one

endeavoured to fasten her selfe ?spake to the Company of the Exeter Marchant to forbeare ffastneing to their shipp, and
beleeveth the tyde then served, well enough for the Exeter Merchant to have moored by her selfe
without relying upon a fast to the sayd other shipp.
