Transcription

To the second article, he referreth hmselfe to the
Charter party arlate And further he cannot depose

To the third and fourth articles he cannot depose./

To the fifth article of the sayd allegation he deposeth and
saith that he the deponent and his Partner this present yeare freighted
severall shipps to Norway and hath used that trade many
yeares, and he saith that it is the custome of the deponents certaine
knowledge and experience [?XXX] the said trade for Merchants
to receive and allowe upon account with the Masters
a long halfe deale for a whole deale, and alsoe two
peices for a whole deale and most especially he saith it is
allowed unto Swinsound deales in regard that they are
the most slabby and ill conditioned deales that come out
of the whole Countrey, And he further deposeth that
the busines now in controversy being by both parties litigant
agreed upon to be putt unto arbitration and he the deponent
being chosen by the producent for one of his Arbitrators
was intrusted and informed touching the whole busines
and upon his shewing him the deponent the bill of loading
of the said deales arlate or a copy thereof, it did appeare
to him this deponent that it was a very fayre and
honest accompt and by the sayd Beale the producent
And further he cannot depose./

To the sixth he cannot depose./

To the seaventh article he deposeth and saith that the producenta nd his Owners are
damaged by the nonpayment of the money due to them
at least lx li, in his this deponents iudgement, who hath
many parts in shipping, and therefore knoweth that the
producent hath much suffered in having his shipp lying
idle for so long And further he cannot depose.

To the eight, ninth and tenth articles he referreth himselfe
to the Lawes. And further cannot depose/

To the last he saith his former deposition is true/

To the Interrogatoryes/ [CENTRE HEADING]

To the first Interrogatory he answereth negatively./

To the second Interrogatory he knoweth not to answeare./

To the third article he answereth that his precontest Richard
Grassingham told this Rendent that he had viewed the
deales interrate, and that he had estimated them to bee as
many in Number as the Accompt mentioned which the
producent shewed this Rendent, And further he
cannot answeare./

Shipwright, where he hath lived 7 yeares, aged about 31
