Transcription

in and to the said Richard Le Bas Merchant of this City of London, whoe was
and is accompted the true and lawfull Owner and Proprietor of one fourth
part of the said shipp and of her tackle and apparrell and furniture, as this
deponent and the other parties in this cause producent were and are each of them
respectively Owners each of 1/4 th part of the said Vessell apparell and furniture
The premisses hee well knoweth for that hee was present at Caen, and interessed
in the buying and selling of the said 3/4. parts as aforesaid, and for that hee
this deponent payd the summe of nyne hundred and fifty gilders hollands
money to the said Mr Badenhop to and for the use of himselfe and the
other former Owners of the said 3/4 parts of the said shipp, whoe together
eith ther said Le Bass brother to the said Richard Le Bas of London and
the said Mr Robbins the former Master of the Vessell now Claymed did
constantly affirme and declare to this deponent that the said remaining 1/4 th
part of the said Vessell did really and truely belong to the saud]
Richard Le Bas. And further cannot depose:-/

To the third and schedule annexed hee saith hee knoweth nothing thereof

To the 4th hee saith, That hee this deponent hath knowne the arlate
Richard Le Bas lving and inhabiting here in London for about 6. or
7. yeares last past, and saith hee is commonly and henerally reputed a
Subject of this Commonwealth. And further cannot depose:-

To the 5th hee saith, That the said Vessell being soe bought at Caen as
aforesaid shee was sett out from thence to Barfleur [OR harfleur] in ffrance
this deponent being then Master of her, and that in her Course thitherwards
shee was mett withall surprized and taken by the Tyger friggatt in
the immediate service of this Commonwealth, and shortly after such seizure
this deponent being brought up to Portsmouth was examined, but could not well
understand those that toke or sett downe his said examination, this deponent
being a hollander and not able to write or to speake English, but in a very
imperfect manner, And saith, That if in that pretended examination it bee sett
downe otherwise then hee hath here predeposed, videlicet that hee this deponent
and partners had bought the said 3/4. parts of the said shipp at Caen as
aforesaid for 950. gilders hollands money, and that one Mr Le Bas
of London, (who had a brother residing in Caen) was Owner of 1/4 th
part of the said shipp or Vessell, then the same is by errour and mistaken
occasioned by his this deponents not understanding of the English tongue, for that
the trueth was and is as this deponent upon his examination hath
deposed, and doeth upon his Oath and Conscience solemnly declaare and
depose, And not otherwise:-/
