Wight and had sent him then along with this deponent to receive the same
which by the meanes aforesayd hee could not doe but returned without the same
and being soe disappoinmted refused afterwards to take the same upon the same conditions
he had bargained for, by reason his bargaine was not then performed, And hee
saith that after such tyme as the sayd Blake had taken out his sayd first
third the sayd Percivall Gilbert sent this deponent againe with a boate to
receive his second third and this deponent did within fower or five dayes
at the most after take the same out of the sayd shipp the Brandaryes,
and at the taking out thereof left on board the sayd shipp a good quantitie
of salt (but how much hee knoweth not nor how long the same remayned soe
on board And hee saith that by reason the sayd Knight could not receive his
sayd 28 weigh of salt according to bargaine at such tyme as this deponent and
hee came first to demande the same, the sayd Knight refused as aforesayd to
take the same salt at the price agreed upon whereby the sayd Gilbert was
afterwards forced to conclude a new bargaine with him for the same and thereby
lost three halfe pence in every bushell of salte, of the rate the sayd Knight was
by the first bargaine to have paid him for the same which amounted to
seaven pounds odd money sterling And further hee cannot depose saving hee
saith hee hath seene two an acquittances subscribed with the name of the sayd
Samuell Williams for the payment made by the sayd Gilbert to the sayd [?subcommissioned]
for the sayd salt./
To the Interrogatories [CENTRE HEADING]
To the 1 Interrogatorie hee saith that by reason hee kept noe memoriall in writing thereof
hee remembreth not perfectly what moneth or day of the moneth hee went [?first] with
the boate aforesayd to receave the sayd Gilberts salt from aboard the shipp Brabdarys
but saith the ame was about the latter end of September or beginning of October last
And further saving his foregoeing deposition to the allegation to which hee
referreth hee cannot depose
To the 2nd hee saith hee was not present when the shipp ladeing of salt was sold and therefore cannot
of his knowledge depose upon what conditions as to the delivery thereof the same was sold but
hath heard the whole shipps ladeing was bought by the Interrate Blake and Gilbert and
that they were to take the whole ladeing of salt out within 14 dayes after sale thereof
And the sayd Williams told this deponent that Blake was to take the first third of the sayd
ladeing And further hee cannot depose/
To the 3 Interrogatorie hee saith hee knoweth nothing nor hath heard any
thing to the effect Interrate more then what hee hath before deposed
To the 4th Interrogatorie hee saith that the buyers ought not to send any labourers
to helpe to unlade the sayd shipp of the sayd salt or to measure the same and saith if the shipps company
were in a readines to deliver the same and measure it and the weather not wett and boates
reasy to receave it 50 weigh of salt might be delivered
in four or five dayes And hee beleeveth the whole ladeing of salt in the shipp
Branderies (if weather were fayre and boates ready and the shipps company
ready to deliver the same) might have bin delivered within 14 dayes and
further hee cannot depose/
