And saith that the said Collard and company (while the said shipp the
Saint Mary de Guarda lupe was under their power) only tooke out of her
some chests of sugar and some other pettie matters which hee knoweth being
all the while aboard her to the time of her seizure by the Saphire the
English frigot. And otherwise hee cannot depose saving the said Collard
and company never carried the Saint Mary into any port in ffrance, nor under the
commannd of any fort or castle in ffrance.
To the seaventh hee cannot depose.
To the 8th hee saith that assoone as the said shipp the Saint Mary was
brought into Plimouth by the Saphire, the Captaine of the Saphire
turned all such of the said Callards company as hee put aboard
her (consiting in soldiers and marriners of about 19 persons)
ashore, but kept this deponent and the other six of the Saint Mary
her company aboard, telling them that they must serve the
Parliament, and soe after the said vessell had bin about five dayes
brought into Plimouth, this deponent and his said six companions
belonging to the Saint Mary, without being carried before any Magistrates
or any wayes examined, were sent out to
sea in the said frogot the Saphire in the service of this State
and after that they had bin about 29 dayes at sea, the said frigot
met at sea with eight shipps of holland or of other places
of the Netherlands, and then this deponent and his said six companions
made request to the Captaine of the said frigot ther Saphirre
(being the same Captaine that tooke them) that hee would suffer them
to goe into the said dutch shipps, that soe they might goe ashore
in ffrance or the lowe Countries and soe dispose themselves for
their homes and occasions, or to that effect, whereunto the said
Captaine condiscended, and put them into shipps namely
each man into a severall shiipp, by which meanes this deponent
got ashore at Saint Martins in ffrance, and thence hee went to
Rochell, where hee met with his precontest Lucas hendrickson
Sinck master of the Mary, who was before carried into ffrance
by the said Collard, and thence the said master came afterwards for
England, and this deponent went for Amsterdam. And saith that
such their bringing into Plimouth was on or about the 11th of
October last newe stile. And otherwise hee cannot depose.
To the 9th article hee saith that after the said seizure by the Saphire, and before
the bringing of the Saint Mary into Plimouth the Captaine
of the Saphire caused this deponent and his six companions to be
brought aboard the frigot, and that hee the said Captaine and
company fetched amd caused to be fetched about 33 or 34 chests of
sugar out of the Mary into the said frigot, two boates lading
of Campecha wood, three or foure bales of Cochenille,
some ginger, and about 540 hides, which hee knoweth being then
aboard the frigot, and after their
comming into Plimouth this deponent sawe the said goodss there sent
ashore out of the said frigot, but what they tooke out of the said Mary at Plimouth
heee saith hee cannot depose. And further hee cannot depose,
