french friggat when the said shipp Santa Maria and lading were retaken by
the said Saphire ffriggatt, and saw the goods plundered out of the said shipp
brought ashoare at Charente in ffrance, and afterwards brought to Rochell
And further cannot depose./
To the 4th article hee saith, That the said shipp the Saint Mary de guarda Lupa
so seized with her lading by the said Collart, and the Saint Mary so retaken by
the said Saphire friggat was and is one and the selfe same shipp, which hee
well knoweth being Master of her and seeing her said taking and retaking, and
having been aboard her since such her retaking here in the river of Thames
And further cannot depose./
To the 5th hee saith, That hee this examinate being taken out of his said shipp
by the said Collart and Companie, knoweth not what examination was made
of his owne or Collarts men that were retaken in her by the said Saphire
friggatt otherwise then by relation of some of the said shipps Companie
who were so retaken in her who have affirmed that they were turned
away without examination, and that onely some of Collarts men were
examined by the said retakers./
To the 6th hee saith, That the said ffrancisco Lopez, don John Baptista
de Pontey ffonty papes and Asensio daranga Mederaoes were and are
all of them inhabitants in Teneriffe aforesaid under the Jurisdiction and
Subjection of the king of Spaine, and for and as his Subjects were and are
generally accompted reputed and taken. And further cannot depose/:-
To the 7th hee saith, That at such tine as the said shioo the Saint Mary de
Guarda Lupa was retaken as aforesaid by the said Collart and Company the
said Collart in this dfeponents presence delivered unto Jocha[?im] Jansen his
Leiutenant who was sett aboard thesaid shipp severall papers bills of lading and
writings declaring the proprietie of [?the] said shipps lading, all which papers this
deponent firmely beleeveth to have come to the hands and possession of the said
retakers the Captaine and Companie of the said Saphire frigatt. And further
cannot depose./
To the Crosse Interrogatories:-/ [CENTRE HEADING]
To the first Interrogatorie hee saith and deposeth, That hee this rendent was
not aboard his said shipp the Saint Mary de Guarda Lupa when shee was so
retaken by the Saphire friggatt being then aboard the said ffrench man of
warr, and hath belonged to his said shipp onely this Voiage, And otherwise
negatively./
To the second hee hath knowne the parties interrate onely this Voiage, and saith
they are all accompted Subjects of the king of Spaine, and are inhabitants at
Teneriff aforesaid, And further cannot depose./
To the third negatively for his part, and further cannot depose./
To the fourth hee saith hee saw and was in Companie with all the parties
interrate at Guarachicha in Teneriffe whilest the shipp interrate remained
there, and saith the said goods by the said Owners order were sent and brought
aboard the said shipp by Barquiers, and saith hee saw severall of the said goods
brought out of the publique douanes or Custome howses at Santa Cruz and
