that shee stood noe neede of pumpeing above once in fower or five
howers and saith hee well knoweth that the Company of the sayd shipp were
very carefull during the whole voyage to plye the pumpe soe often as occasion
required and did use all diligence in that kinde and alsoe by carefull and good
stowing of the goods on board her to prevent them from receiving
any damage the premisses hee deposeth being Masters mate
and aboard as aforesayd all the sayd voyage and seeing the premisses done/
And further hee cannot depose/

To the last hee saith his foregoeing deposition is true./

Examined on the sayd allegation

Thomas Parkis of Wapping in the parish of Stepney and
County of Middlesex Mariner Carpenter of the shipp Mary
and Anne aged 23 yeares or thereabouts a witnes sworne
and examined saith and deposeth as followeth videlicet

To the first article of the sayd allegation hee saith that hee this deponent
was Carpenter of the sayd shipp the Mary and Anne the voyage now in question
and knoweth that in the moneths of November and december 1654 shee then
laye at Mallega in Spaine and was then a very tight and strong shipp and fitt
to carry any Merchandize, this he the better knoweth being Carpenter of
her And further to this article hee cannot depose./

To the second hee saith the sayd shipp having receaved in her lading at
Mallega aforesayd departed from thence in the moneth of december 1654
with intente to come with her sayd ladeing for London but in her course
thitherward did about the 22th of the sayd december and about thirty leagues from the
Southward Cape arlate meete with a very violent storme which continued
at the least twenty fower howers with such extreame violence that the sayd
shipp could beare out noe sayle at all, but the company for the better preservation
of the sayd shipp and her ladeing and their owne lives were forced to take in all
her sayles which notwithstanding the violence of the storme aforesayd was soe great that it caused the sayd shipp to drive and lye all alonhe upon her side in
the sea whereby shee could not choose but take in and did take in much water, and had
her company put out any of her sayles the sayd shipp and her ladeing had
without doubt perished and foundered in the sea the premisses hee deposeth being
Carpenter and aboard her./

To the third hee saith that after the premisses videlicet about the 29th of the sayd
Moneth of december the sayd shipp being then thwart Cadiz mett with
an other very violent storme which continued above eight howers with
that violence that the sayd shipp was able to beare noe sayle without being
thereby put in great perill of perishing and foundering in the sea, and that
through the violence of the sayd storme the sayd shipp brake her mayne night and sprunge a leake allsoe and the water
beating sore upon her and coming over her deck shee tooke in much water
where the mayne night was broken but at length the winde turning Contrary the arlate Captaine Greene (the Master
of the sayd shipp) and company put into Cadiz where hee this deponent stoppt
the leake she sprange in the sayd storme and mended her mayne night and [?XXX]
her
