To the Crosse Interrogatories. [CENTRE HEADING]
To the .1. Interrogatory he saith he was a passenger aboard the Salvador att the tyme
of seizure and came aboard att Cadiz in October 1652.
To th 2. Interrogatory he saith he hath knowne Joachim Schaer interrate about
eight yeares. and saith he saw him att Saint Lucar as aforesayd but not att Cadiz.
and otherwise referring to his former depositions he cannot depose.
To the 3. he saith that the sayd Schaer is the producents factor and he knoweth
the sylver in question was laden by him for the reasons aforesayd. and
otherwise he cannot depose.
To the .4. he saith the sayd Schaer is an Hamburgher and for about eight
yeares hath lived att Saint Lucar where his howse is upon or neare the Strand.
and he lived before all his tyme by repute att Hamburgh, where the producent
allsoe liveth as aforesayd in his howse neare the Mill bridge. and referring
to his foregoeing depositions cannot further depose.
To the .5.th he saith he was not present att the ladeing of the moneyes in
question, and therefore cannot depose further than as aforesayd.
To the 6. he saith he was not present att the signing of the foresayd bills of
lading. but beleiveth they were firmed by Christian Cloppenbergh att
Cadiz about the 18th of August which day they are and were dated for that
he saw one of them not long after the sayd 18th day of August
att Saint Lucar as aforesayd.
To the .7. 8. amd nynth Interrogatories he saith he is well assured that the sayd Joachim
Schaer did lade the moneyes in question for the reasons predeposed, and saith
he saw an entry of the sayd moneyes with the number and marke thereof
in the shippbooke of the Salvador agreeable to the sayd bills of lading.
and further cannot depose.
To the tenth negatively.
To the eleventh 12. 13. and 14th. he saith that about two yeares now past the
sayd Joachim Schaer receyved in severall shipps from Hamburgh and
fflanders severall quantities of linnen Cloth wax and other goods
the particulars whereof names of the shipps wherein they were so sent or value
of the sayd goods he knoweth not; and the sayd Joachim Schaer hath told
this deponent that he had generall order to remitt the sayd goods in sylver
to the producent upon all fair opportunityes, and afterwards told this deponent
as aforesayd that he had laden the moneyes now in question for the Reckoning
and riske of the sayd producent as part of the proceed of the for sayd goods.
To the 15th. he saith he was borne att Nair in Lakeland and liveth as a
merchant stranger sometymes in Spayne sometymes in fflanders as occasion
offerrs without any fixed abode. and otherwise negatively.
To the .16. he saith he saw the foresayd moneyes in the howse of Jochim Schaer
att Saint Lucar where he bought and procured the same as himselfe told this deponent. but
saith he was not present att the buying or procureing thereof and hath above
sett forth the reason of his knowledge touching the true Owner of the sayd
moneyes to which reasons he referreth himselfe and otherwise cannot depose
To the 17. 18. 19 and 20.th Interrogatories he saith he cannot depose.
To the 21. he saith the (sic) knoweth the bill now shewne him to be
one of the Originall bills of lading for the sylver in question because it
doth agree in the firme marke and contents thereof with another bill
of lading for the same which this deponent saw att Saint Lucar in th ehands
of Jochim Schaer as aforesayd And otherwise he cannot depose
