Examined upon the said Allegation
3uis.
Michaell Van Lubkin of the Citty of Hambourgh
Captaine of the ship Morning Starre aged [BLANK IN MANUSCRIPT] yeares
or thereabouts sworne and Examined deposeth
To the first second third and fowerth articles of the Sllegation in this
cause hee saith and deposeth. That in or about the moneth of
ffebruary last past there was at Cadiz in Spaine laden and
put on bord the shippe the Morning Starre whereof this deponent
then was and now is Captaine by the factors and correspondents of the
producent Augustine Lambert and for his use and accompt
two baggs No. 1. 2. of Ryalls of Peru Coyne contayneing eight hundred
[FIRST MARKE, LH MARGIN]
peaces of eight marked with the first marke in the margent And one bagg
[SECOND MARKE, LH MARGIN]
of silver weighing 139 markes and a halfe marked with the second marke in
the margent to bee from thence transported in the said ship to Dunquirke
where the same was and is consigned to bee delivered for the use and
accompt of him the said producent who was and is comonly accompted
a fflandrian by birth and habitation and the true and only Owner thereof
which hee knoweth hee this deponent when the said money and plate were
laden on bord the said ship being Commander thereof did order Garrett
Martens his purser and his precontest Lucas Wrade to receave the
same and upon Notice from them of their receipt thereof did signe
bills of ladeing for the same in and by which the said money and plate is [?XXXX]
to bee laden for the propper accompt and riscoe of the said producent. And
further cannot depose saveing that upon such the ladeing of the said plate
and money on bord the said ship ffrancisco de la Seirpe and [?Joachim]
[?Schaez] the laders thereof did tell this deponent that the same was
by them soe laden for the propper Accompt and Adventure of the said
producent And further cannot depose/.
To the 5.th 6th and 7th. articles of the said Allegation And to the two bills
of ladeing annexed and now showed unto him hee saith and
deposeth. That upon such the ladeing of the said money and plate
on bord the said shippe as aforesaid hee this deponent did signe
three severall bills of ladeing of one Tenor in [?XXX] and date for the same
two bags of money and three severall bills of ladeing of one Tenor
and date for the said barre of silver, one of each of which said bils this
deponent had and brought along with him in the said ship and the
other two of each sort hee gave to be left with the said parties the laders
thereof who since that time as hee conceaveth sent the same hence
from Spaine to fflanders to the producent by whom the same have
bin and are sent from thence to this Citty as he beleeveth. And saith
that the bills of ladeing annexed and now perused by him were and
are two of those very originall bills of ladeing which this deponent [?had]
signed at Cadiz upon the ladeing of the said money and plate
