Transcription
at Sea neere the Southward Cap[?a] laden with Butter, Tallow, hides
pipe staves and Salman bound for Saint Lucar for the accompt of
some Irish Men who had formerly taken the said ship from the
said dad. And saith that at the said tyme of the said ships being
brought into Leghorne the said Master bye himselfe and diverse
of his company did tell this deponent who when they came first into that Rode was abord the Sampson that shee was the said
Paul Dads ship and some of them he saith then said in this deponents hearing
and presence that thay should bee never a penny the better for the said
Ship because she belonged to the said Dad. Howbeit hee saith that
after the said ship had bin at leghorne a while, the said Captaine
Ashley did there sell away and dispose of her and her ladeing
to his owne use which hee knoweth to bee true because hee
this deponent was offered a Command in the said ship by the merchant
that bought her att leghorne of the said Ashley and was there
when hee soe sold the same, and then and there heard it publiquelye
famed and reported that shee was the very same ship which did
formerly belong unto the said Dad and did well knowe her soe to bee. And otherwise hee
cannot depose.
To the last Interrogatorie hee referreth himselfe to his foregoeing deposition.
And otherwise hee cannot depose.
To the Crosse Interrogatories [CENTRE HEADING]
To the first Interrogatorie hee saith hee hath knowne the In[?terrogated] William
Ashley by the space of theise thirteene yeares, And saith hee
is not any wayes of kin to the producent nor doth hee affect [?anie GUTTER]
of the parties litigant more then another but wisheth that iustice may
take place [?h]erein. And further hee cannot depose
To the second Interrogatorie hee answereth negatively to every part
thereof.
To the third hee saith that hee sawe the ship interrogated in the
possession of William Ashleye at Ligorne and was himselfe abord
her at that tyme.
To the last hee saith hee hath not soe deposed.
