Transcription

haveing receaved a letter from his Master and
order to deliver the same at London to his father assoone as hee could
after hee was set ashore in England hee did make what
hast[?e] hee could hither but hee being stripped and
travelling on foote could not bee heere sooner than
in 12. or 13. dayes space But what the contents of the
said letter were hee knoweth not. And otherwise
hee cannot depose.

On the behalfe of Michaell}
da Espinosa and others against}
Captaine Mootham}

Examined upon the Interrogatories ministred on
the behalfe Of the said Espinoza and Company.

Captaine Abraham Mootham of Redriffe
in the County of Surrey marriner aged 41 yeares
or thereabouts sworne and Examined

dt [XXX] et [?prop].

To the first Interrogatorie hee saith and deposeth that upon this
deponents seizure of the ship the ffortun[?a] interrogated hee
fownd a box aboard the said ship wherein were some
papers or writeings but what they concerned hee
knoweth not but saith that hee this rendent brought up the
said box from Portsmouth to this Citty and heare
delivered the same unto Mr Smith his Proctor who
forthwith returned the same againe to the C[?ommissioner] for
the Examination of the wittnesses at Portsmouth And
further hee cannot depose

To the second Interrogatorie hee refrreth him selfe to his foregoeing
deposition And otherwise hee cannot depose sayeing
that hee this deponent to his knowledge or remembrance
never sawe any ffrench Charter partie or contract which
concerned the said ship amongest the rest of the papers
which were in the said Box.

To the third Interrogatorie hee answereth negatively say[?v]eing
that hee never sawe or heard the said Charter partie read
either abord his ship or abord the ship the ffortun[?a] wither
by anyone of his Company or by any man else
whatsoe ever, nor did hee heare any of his Company speak
any words to the effect interrogated And further hee cannot depose.

To the last Interrogatorie hee saith that there was one John Janson who was one
of this deponents ships Crew but hee never saw or heard the said Johnson
read any ffrench paper or Charter partie nor doeth hee know where
the same ever was or what is become of it. And further hee cannot
depose.
