And William Austin and Josias Best owners of one 8th part
and that the arlate Edward Arlabeere was then owner
of one sixteenth part and the arlate Thomas Middleton
was then owner of one eighth part of the said
shipp and of her tackle and furniture And these
Rendents further beleeve that the arlate John
Allen theire Proctor being in Michaelmas terme
last past which was above five yeares after the
voyage in question was ended ordered by the Judges
of this Court, to specifie the names of
the parties for whome he appeared as Proctor
in this cause and of what partes of the said ship
and of her tackle and furniture they were severally
and respectively owners, and having soe short a time
assigned him for the doeing thereof, that he could
not within the same be fully and sufficiently
informed how to make and perfect the said specification
he the said Proctor dud de factor and to avoyde contumacy
only and without any speciall mandate or instruction
in that behalfe, give in a specification into this Court
and did therein by error and having hearde some
generall discourse that ffrancis heath was lately
an owner, by mistake apprehending that he might
be an owner for the voyadge in question did
by error specified the name of the said ffrancis
heath as owner of a 16th part of the said shipp
and one of the company of the said Middleton
and Arlabeer in this suite whereas in truth as they beleive
the title of the said heath came in afterwards and
that he the said heath was not nor is nay of the
said Company or of the parties agent in this cause
nor was during the voyage arlate owner of
any part of the said shipp as these Rendents
beleeve and the said Allen did alsoe in the said
specification by mistake nominate Thomas
humble as an owner but of one 16th part of the
said shipp whereas in truth he was at the
time arlate and is owner of one 16th and one 32th
parte
