and County of Middlesex Porter aged thirty<br />
three yeares or thereabouts a wittnes sworne<br />
and examined saith and deposeth as followeth<br />
videlicet./
To the first and second articles of the sayd libell hee saith the arlate John Bayley in<br />
the moneths and tyme arlate was Commonly reputed to be the Master<br />
and Commander of the arlate shipp the ''Imployment''<br />
and did as Master of the sayd shipp agree with this deponent and his contest<br />
Edward Cranford and fowerteene others to unlade his sayd shipp of her<br />
ladeing of Coales then on board and bargained with them to doe the same after<br />
the rate of twelve shillings a man And further saving his subsequent<br />
deposition whereto hee referreth hee cannot depose./
To the third hee saith hee referreth himselfe to the lawes and customes<br />
arlate and further hee cannot depose/
To the 5th hee saith hee referreth himselfe to the rules and orders arlate<br />
and further cannot depose/
To the 7th hee saith that hee knoweth for that hee was one of the labourers<br />
who helped to unlade the shipp ''Imployment'' that<br />
within the tyme arlate the sayd shipp was moored in<br />
the River of Thames neere Execution dock and about the middle of the<br />
Thames where in likelyhood shee lay in a safe place and cleere of all danger and this deponent<br />
knoweth that shee ridd there in safety a tyde or two at least as<br />
before the damage in question happened And this hee the better knoweth for that<br />
hee this deponent and the rest hyered as aforesayd to unlade her wrought upon<br />
delivery of part of her ladeing of Coales the day before the ayd damage happened and delivered about fifty chalder<br />
of them from on board her which were then all drye and well conditioned<br />
And further to this article hee cannot depose/
To the 8th 9th 10th 11th 12th 13th 14th 15th and 16th articles of the sayd libell hee<br />
saith that hee well knoweth that the sayd shipp for that her ladeing delivered<br />
from on board her the day before the same damage happened was all drye and<br />
well conditioned, and hee saith as before hee hath deposed that the sayd Bayly<br />
did agree with this deponent and his sayd Contest and the other fowerteene men to<br />
unlade his sayd shipps ladeing of Coales at the rate of twelve shillings a<br />
a man and this deponent and his sayd Contest and the sayd other fowerteene men in<br />
persuance of the sayd bargaine did (the day before the damage in question happened)<br />
unlade about fifty chalder of Coales out of the sayd shipp, and intended to<br />
proceedehipp, and intended to<br />
