The last day of May .1655: [CENTRE HEADING]

The Lord Protector against the shipp the Saint Paul}
and her lading and against Captaine Philipps}
Budd Smith:}

Examined upon an Allegation on
the behalfe of the said Captaine Philipps.

Smith dt.

Ferdinando Hespel of Lisle or Ryssell in
fflanders Merchant aged 26. yeares or thereabouts
a Wittnesse sworne and examined saith and deposeth
as followeth videlicet:/

To the first article of the said Allegation hee saith hee knoweth nothing thereof:-

To the second hee saith, hee very well knoweth the arlate Emmanuel
de Croyes, and hath so knowne him for about 4. or 5. yeares last
past, during which time hee hath lived at dunquirke and other parts
of fflanders, and in England, and hath been and is commonly reputed
and well knowne to be a Merchant, but never was esteemed or
reputed a Seaman so farr as this deponent ever heard or understood
And further hee cannot depose./:

To the third hee saith, That hee this deponent being in London in the
moneth of december 1653. last past perceived a letter of advise from
one Mr Salisbury a Merchant there imporying that the shipp the Saint
Paul arlate with a lading of wynes was brought up to Southampton
as Prize, And further hee cannot depose:-/

To the 4th hee saith hee knoweth nothing thereof./

To the 5th article hee saith, That about the latter end of december or
beginning of January 1653. last past hee this examinate was informed
by Captaine Isaac Philips the producent in this Cause, That hee the
said producent had about that time obtained an Order or decree of this
Court for the sale of the said shipp and her lading, And referring himselfe
to the Registry and proceedings of this Court hee saith hee cannot
further depose:-/

To the 6th hee saith, That upon or about the 20th day of January
1653. aforesaid, the said producent Isaac Philips did here in London
sell and dispose of the said shipp Saint Paul and her lading of wynes to this
examinate being the arlate fferdinando hespell for the summe of
2500 li sterling, which summe was to be paid by this deponent to th
said producent or order upon the delivery of the said shipp and
wynes at London in case the same were brought about, and
here in safety delivered to this deponent before the 20th day of
ffebruary 1653. then next ensueing and not otherwise, and the
said shipp and goods to be so brought about at the proper charges
of the said producent, and the Customes due for the said
Wines were by this deponent to be allowed to the said Captaine
Phillips over and besides the summe aforesaid, The premisses
