holt that the said papers were taken in and came out of the<br />
shipp. And this deponent having now seene the papers that were brought [?XX GUTTER]<br />
this court as comming out of the said shipp verily beleeveth [?XXX GUTTER]<br />
to be the very same without dimunution addition or alteration<br />
were soe received by this deponent and the said mr holt, and<br />
acknowledged by the said Baggaert, for hee saith that after [?the GUTTER]<br />
said witnesses were examined, the said major and towneclarke<br />
made and sealed the said papers together with the said examination<br />
and a certificate, and then the same were by Samuell Williams<br />
clarke of the Prize Office there carried to the Post and sent [?to the GUTTER]<br />
Commissioners for Prize goods to london. And further hee cannot<br />
depose, saving that this deponent and the said mr holt have [?XXX GUTTER]
and sent to this [?CXXert] a certificate touching the said papers, which<br />
certificate (dated the twelveth of November last) hee averreth to<br />
containe the truth and to be wholly true, and [?XXXing] hee averreth [XXX]<br />
[?discussions] annexed to the said papers to be of the said towne Clerke, [?wXXX GUTTER]<br />

To the sixth hee referreth himselfe to the said papers soe brought [?into GUTTER]<br />
this Court as found aboard the said shipp as aforesaid, and further<br />
hee cannot depose.
To the seaventh hee saith that the time arlate there was and is<br />
open hostilitie betweene England and Spaine, and therefore [XXX GUTTER]<br />
for the reasons contained in the said [?XXX GUTTE]<br />
and examinations, this deponent beleeveth the said shipp the [?tyme XXXX GUTTER]<br />
good prize to this Commonwealth, and to be confisc[?able] to the [?Keepers GUTTER]<br />
of the libertie of England by authoritie of Parliament. And<br />
further deposeth not.
To the eighth hee saith his foregoeing deposition is true.

To the first hee saith hee never saw the said shipp [?XXX] or the [?sayd GUTTER]<br />
Baggaert the master before such their bringing up to Portsmouth as<br />
aforesaid, and saith hee is one of the deputies or sub Commissioners<br />
for Prize goods at Portsmouth.
To the second hee saith hee was by the said shipp the [?''hen''] [''?hXX''] [?XXX GUTTER]<br />
upon her said first bringing into Portsmouth and<br />
order for and saw the lading of the said prisoners. but was not [?XXX GUTTER]<br />
or received any papers aboard her, the said papers being delivered<br />
unto this deponent and his said precontest ashore by the said Captaine<br />
Parker and Baggaert, and such as Captaine Parker delivered [?XX GUTTE]<br />
were soe delivered in the presence of the said Baggaert and are the [?XXX GUTTER]<br />
which the said Baggaert owned upon his oath as aforeasid. And<br />
saith hee knoweth by certaine papers that are amongest them the<br />
said papers remaining in this Court are the same [?XXX GUTTER]<br />
and which came out of the said shipp, and hee verily beleeveth [?XXX GUTTER]<br />
than was not nor is any person in Portsmouth that [?XXXX or GUTTER]<br />
write the hand of any of them or counterfeit such hand, [?nor GUTTER]<br />
was there any person as hee beleeveth in Portsmouth that [XXX GUTTER]<br />
spoke or understood Spanish for hee saith they were [?XXXX] to send [?XXX XXXXX] for som Interpreter for the Spanish [?XXX XXXX], nor doth this deponent understand any<br />
