Transcription The 12th of October 1655./ [CENTRE HEADINGThe 12th of October 1655./ [CENTRE HEADING] The clayme of James Talbot Robert Girlinge}<br /> and company late Owners of the ''hopefull Mary''}<br /> of the which Jeremy Tye was Master for an}<br /> anchor two Top masts and severall peeces of Ropes}<br /> Taken upp by some fishermen of Barkeing and}<br /> presented to this Court the 13th of June 1655}<br /> Suckley Budd} Examined upon an allegation given<br /> in by Mr Suckley the 11th of 8ber 1655./ '''T: jus:''' '''Jeremy Tye''' of Limehouse in the County of Middlesex maariner<br /> late Master of the shipp the ''hopefull Mary'', aged about 29<br /> yeares a witnes produced sworne and being examined hee<br /> deposeth as followeth videlicet./ To the first and second articles of the said allegation he deposeth and saith that in<br /> the monethes of Aprill and May 1655 arlate the producents James Talbot Robert<br /> Girling and company were owners and proprietors of the shipp the ''hopefull Mary'' arlate<br /> and of her Tackle apparrell and furniture; and soe generally accompted, and this deponent<br /> was then master of her. And saith that on or about the sixth day of May arlate the said<br /> shipp the ''hopefull Mary'' being in her course from Newcastle (laden with coales) for<br /> this Citty of London, was by Extremity of weather driven on a place called the<br /> Middle ground, which is over against Wivenhoe in Essex and was there wracked<br /> and cast away, But the Company of the said ''hopefull Mary'' saved themselves in the[?ir GUTTER]<br /> boate and got on shoare, and soe preserved theire lives, And saith that [?Samuel GUTTER]<br /> Charsley William Townesend and one Portman of Barkinge did take upp two<br /> Top masts belonging to the said ''hopefull Mary'', which as themselves confessed to<br /> this deponent they found adrift in the sea, and confessed they did also cutt off from the said wrecked<br /> vessell one Anchor and divers peeces of Ropes belonging to her, which [?this GUTTER]<br /> deponent saw in theire Custody, and possession att Barkeing aforesaid, and<br /> which this deponent is informed are presented to this Court. hee further saith that [?the GUTTER]<br /> said goods soe by them found and [?XXsented] did belong to the said shipp the ''hopefull Mary''<br /> att the tyme of her castinge away; and the said Talbot Girlinge and company were<br /> and are the true and lawfull owners and proprietors thereof All which this deponent<br /> knoweth to bee true for that hee hath bin master of the said vessell any time these<br /> 4 yeares last before her such castinge away and hath knowne the said Talbot [?and GUTTER]<br /> company to bee owners of her for all the said time, and for all the said time this<br /> deponent gave his accompts to them as owners, and was present on board her att such time<br /> as shee was driven on ground where she was lost as aforesaid./ And further [?to GUTTER]<br /> the said allegation hee cannot depose./ To the Interrogatoryes./ [CENTRE HEADING] To the first Interrogatory hee answereth and saith that att the tyme the shipp interrate was<br /> cast away hee was master of her and soe had bin for about 4 yeares before, and to the [?rest GUTTER]<br /> of the said Interrogatory hee answereth negatively./ To the second Interrogatory hee answereth and saith that hee very well knoweth the two Topmasts interrate<br /> when hee saw them in the Custody of the said Charsley and [?Towasead] as also the Anchor<br /> to belonge to the said vessell the ''hopefull Mary''; which this deponent tooke speciall notice [?of ?since] he sailed in her as master 4 yeares<br /> And the said Charsley and Towasead did confesse to this deponent that they did cutt off [?XXX GUTTER]<br /> Anchor from the said wracke and some of the Ropes, and that they found they [?XXX GUTTER]<br /> was the said place of the Wracke, there beinge noe other shipp att the same [?XXXX GUTTER]<br /> cast away or wracked.
