that hee knoweth that it is usuall when a parcell of fine goods come<br />
if the sayd shipps Company bee in hand with ladeing course goods into an open lighter<br />
to put the fine goods betweene decks, and finish the ladeing of the open<br />
lighter with course goods which arise next (the fine goods being soe remobed)<br />
and hee knoweth the Company of the ''Smirna ffactor'' did soe before they<br />
had fully unladen their sayd shipp And further to this Interrogatorie hee<br />
cannot answere./.
To the third Interrogatorie hee saith the goods in controversie<br />
wree soe farr as this rendent could and did observe were outwardly well<br />
conditioned and free from damage by wett when they were delivered<br />
out of the shipp ''Smirna ffactor'' into the open lighter Interrogate<br />
and beleeveth they were soe And to the rest of the Interrogatorie<br />
hee answereth negatively well knoweing noe words to the effect Interrogated<br />
were spoken, nor any other words but what hee hath predeposed/
To the 4th Interrogatorie hee saith hee was intrusted by the sayd mr Mills as<br />
a servant in the lighter where in the damage controverted happened<br />
and is the sayd Mills his servant for weekly wages soe longe as this<br />
rendent and the sayd Mills can agree, and saith hee is not concerned as<br />
hee beleeveth in the damage in question nor shall or ought to suffer blame<br />
therein as hee beleeveth for that hee well knoweth the same happened<br />
after this rendent and the sayd Purse were by the order of the sayd hughs (sic)<br />
his mate dismissed and appointed to come the next morning and after<br />
the sayd hughes (sic) his sayd Mate had told this deponent that hee and the sayd<br />
shipp the ''Smirna ffactors'' company would take care of the sayd lighter<br />
till morning and further hee cannot answere/
To the 5th Interrogatorie hee saith hee this rendent and the sayd Purse were the<br />
lighter men intrusted by the sayd Mills with the open lighter<br />
Interrogate but saith they did not deserte the same without leave when the sayd hughes<br />
Company went to lade fine goods into the cloase lyter<br />
for as is predeposed the sayd hudsons (sic) mate first caused the sayd open<br />
lyter to be loosened from the shipp side and vered her downe lower<br />
by the sayd shipp side towards the sterne to make roome for the cloase<br />
lyter and withall the sayd mate told this rendent that there should bee noe more<br />
goods laden aboard the open lighter till the next morning and told<br />
this deponent hee and his company would take care of her till next<br />
morning and willed this rendent and the sayd Purse to go, and come<br />
againe the next morning early, and thereupon this rendent and the sayd<br />
