employed in the care and Conduct of the affaires of his said brother William<br />
Pym. And further cannot depose./
To the 7th hee saith. That in or about the moneth of Aprill <u>1654.</u> last Certaine<br />
shipps of Saint Mallo then being taken by some of the friggats of this Commonwealth<br />
and here as this deponent hath heard in fact condemned for lawfull Prize, The<br />
Magistrates of the said Towne of Saint Mallo with the Consent of the<br />
Commonaltie of the said Towne did actually seize and cause to be seized upon<br />
all Englishmens goods wares and Merchandizes then in the Warehouses<br />
houses and chambers of Englishmen there residing and trading, And saith that<br />
amongst the rest one Monsieur La Loye a ffrench Merchant and inhabitant<br />
of Saint Mallo aforesaid and a Subject of the ffrench king, under pretence of<br />
taking satisfaction for such losses as hee pretended to have sustained by the aforesaid<br />
seizure of some Saint Mallo Vessells and Merchandizes, wherein hee pretended to be<br />
interessed, having at that time in his hands severall goods wares and Manufactures<br />
which the said William Pym had entrusted unto, and given Credit to the said<br />
La Loy for, did and doeth actually detaine the same, for and in consideration of<br />
his said losses sustained as hee pretends by the English; the said goods wares and<br />
Manufactures amounting to the valew of 11500. livers Tournois, being in English<br />
moneys eleaven hundred and fiftie pounds sterling or thereabouts. The premisses<br />
this deponent well knoweth, for that hee this deponent upon the seizure and detention<br />
of the said goods wares and Manufactures to the value predeposed, hath observed<br />
by sewall letters of advise written from Saint Malo to the producent William Pym<br />
this deponents brother by Thomas Elles his factor and Agent then residing at<br />
Saint Malo, that the premisses were so had and done as is by them predeposed, both in<br />
the generall as to the English Merchants, and in particular as to the losse sustained<br />
by the said William Pym by meanes of the premisses. And further hee<br />
saith hee cannot depose/:-
To the 8th Article hee saith, That all the goods wares and Merchandizes<br />
seized and detained as is predeposed by the said ffrenchmen from the arlate<br />
William Pym, were in fact so seized, and were and are detained from him<br />
and hee totally and absolutely divested and deprived of the same, and of every<br />
part and parcell, benefitt and proceed of the same, upon this onely pretense, that<br />
hee the said William Pym was and is an Englishman and a Subject of this<br />
Commonwealth, And for that the said respective ffrenchmen the seizors and<br />
detainers of the aforesaid goods wares and Merchandizes did and doe thereby<br />
pretend and endeavour the reparation and satisfaction of and for their losses<br />
sustained at sea by some of the shipps or friggats in the immediate service<br />
of this Commonwealth, whereof the said William Pym was and is a<br />
Native and Subject: The premisses hee well knoweth for the reasons by him<br />
predeposed. And further to this article hee saith hee cannot depose./
