'''Peter Lucas alias Lutzen''' a witnesse formerly examined in this<br />
cause and nowe againe sworne and examined saith as<br />
followeth videlicet.
To the said allegation hee saith and deposeth that at the time of the seizure<br />
of the said shipp the ''ffortune'' allegate and her lading by Captaine M[XXXXX] there was a Charter<br />
partie aboard her, by the which it did appeare that the goods in the said shipp<br />
were to be delivered at Amsterdam, and saith that hee this deponent<br />
master of the said shipp upon the taking and seizure aforesaid delivered the<br />
said Charter partie with his owne hand into the hand of the said<br />
Captaine M[?ootham], and the next day the said Captaine caused the same<br />
to be reade by one of his company (who understood ffrench) aboard his man<br />
of warr in the presence of this deponent, which person that soe read the<br />
same declared the contents thereof to this deponent in dutch, and to<br />
those English that were by him, in English, and after hee had read the<br />
same and perused the other papers, hee said, I finde not either by the<br />
Charter parti[?a] or writings that the goods are prize, or to that effect,<br />
this deponents contest John Peterson being then and there alsoe present,<br />
and alsoe present when hee this deponent delivered the said Charter<br />
partie to the said Captaine Mooth[?am]. And otherwise hee cannot<br />
as hee saith depose.
To the Interrogatories. [CENTRE HEADING]
To the first hee saith hee can write and reade dutch, but understandeth<br />
not ffrench, albeit hee hath used to saile thither above fourtie yeares<br />
and hath bin there very many voyages, and saith hee was last there<br />
(before this voyage) about eight yeares since in a shipp of Euchusen<br />
named the [?''Prince''] wherof Corneluis Barker was master, And otherwise<br />
hee cannot answer.
To the second Interrogatorie hee saith that hee heard the contents of the said<br />
Charter parti[?a] read by the Notarie that dr{?e]we it, who read it in<br />
ffrench and a sworne Interpreter or broker declared the effect thereof<br />
to this deponent in dutch as the said Notary read it in ffrench, and this<br />
was at the said Notaries studi[?a] or shopp in Roane, and the same<br />
being soe read the merchant named monsieur Rodriguez and this<br />
deponent being the contractors therein, signed the same, which hee saith<br />
was reall and that there was noe Charter parti{?a] made for ffrance.
To the third hee saith that hee this examinate delivered the said<br />
Charter partie to the said M[?oo]tham with and amongest many other<br />
papers and writings alsoe delivered unto him aboard his the said<br />
Mootha[?nes] owne shipp. and otherwise saving his foregoeing deposition<br />
hee cannot depose.
