some over board, amongst which rubbish he sayth were<br />
severall papers and writings which concerned the ship and<br />
lading, all which papers and writings the said Jacob forced the Captain of the<br />
Experience to leave over board together with the rubbish. Et ar<br />

Ad 19n Arlum dicta Alloms deponit et dicit that these<br />

at such time as she was seized, byt sayth they came<br />
in her company from Brazeele but only met her at<br />
accidentally at sea; and this deponit knoweth of no agreement<br />
or promise made at any time by the said Captain Kingsman<br />
defend or protect either of the said Portugall ships and<br />
not ever heard any such thing spoken of on board the<br />

AD 20 dicit that the capyain and company of the expeience before her X<br />
did not fight with any of the said Dutch ships in defence<br />
of either of the said Portugall ships or ladings, that said captain and X nor did<br />
fight with them, or use any hostile acts towards them<br />
to windward of the ''Experience'' as enemies and had given<br />
one whole broadside at least and a volley of small shot without ever haling<br />
her, and used severall other hostile injusions acts<br />

said these Dutch Captains and companies seized in X<br />
aforesaid she had on board her all the said sugars tobaccos and<br />
hides and wood which were laden and put on board her at<br />

their seizure well worth the summe of fourty five thousand<br />
