the said dutch Captaine of the said shipp that came first up, namely<br />
Captaine Swart, sent away his boate to Vingerla to advise the<br />
Vice Admirall or commander of the fleete, of the said seizure<br />
kept the said shipp ''Beniamin'' under the [?same] from the said thirteenth to<br />
the eighteenth of the said moneth of November 1656, in which time this deponent<br />
often treating with the said Captaine Swart, and instigating him to cleare [?him]<br />
with his shipp, goods and company, and not prevailing, did by word<br />
of mouth protest to and against him of demanding satisfaction for<br />
all dammages that [?had] or should happen for and upon the said [?former]<br />
assault and seizure, whereof hee made slight, and told this deponent<br />
expressely and plainly, that had his grapnell held, hee<br />
would have prevented him from telling of tales, by cutting him<br />
and his company all off. And further saith that on monday the<br />
seaventeenth (old stile) of the said moneth of November, the commander<br />
in cheif of the said dutch fleet comming in the shipp ''Gousa'' with [?seaven]<br />
shipps from Vingarla (which is about twenty leagues to the Northward[X ?of]<br />
Goa) f[or] Goa, and comming before the barr of Goa where the said two<br />
shipps then were, came to an anchor, and the next morning<br />
commanded this deponent and his said cheife merchant aboard<br />
to give him an account of their busines, and they goeing aboard<br />
gave him an account (as they had donee the said dutch Captaine [?alsoe]<br />
before) that they were English and that they came from fort Saint [?XXXX]<br />
with the ''Beniamin'' belonging to English members of the East India company,<br />
bound for Surat, and told him withall how they were set upon by<br />
the said two shipps and declaring unto him all the passages of the<br />
busines, and desired him to consider what<br />
hee would with them, and to resolve shortly, for the longer<br />
they were detained, the greater would be the dammage of<br />
which they did and would protest, To which the said commander<br />
made answer that hee had received a relation of a contrary<br />
tenor from the dutch that were in the action, howbeit hee<br />
was very [XXXXXXX] had passed, and desired that they might<br />
part friendly, only hee insisted that this deponent should give<br />
satisfaction for the dammage which as hee said the ''Mars'' received from [?some]<br />
guns which this deponent had shott from the ''Beniamin'',<br />
but this deponent making answer (as hee saith the truth was<br />
that hee made noe shott at all but<br />
in the necessarie defence of himselfe company and shipp, and<br />
after the said dutch shipp had poured the said broad side into [?her]<br />
and therefore hee could not be liable to any satisfaction, but<br />
should looke for satisfaction for the wrong donne to him and<br />
his principalls, the said commander at length desired hee<br />
might part friends upon an even account, only hee<br />
demanded of this deponent that hee would give under his hand<br />
that they had donne him noe wrong, which this deponent<br />
scrupling, but perceiving, and being plausibly told that<br />
otherwise hee should not be cleared, nor his shipp, hee to get[?t]<br />
the libertie of him selfe, shipp and companie, subscribed<br />
some writing which they drew and tendred him tending to that<br />
propos[?al], though the truth of the storie was alltogether<br />
