that could be used the sayd Shipp the ''Exeter Merchant'' fell fowle of the<br />
boltspritt of the arlate bvessell called the ''Pilgrim'' and shee and the sayd<br />
''Pilgrim'' and a vessell laden with Coales which lay neare the ''Exeter Merchant''<br />
were by the force of the tyde of Ebb which rann stronge forced on ground<br />
before this deponent could or did get on board againe of the ''Exeter Merchant''.<br />
And hee saith that at his this deponents coming on board her hee did<br />
see that the Quarter of the ''Exeter Marchant'' was broken by falling fowle<br />
on the ''Pilgrim'' the premisses hee deposeth being an eye witnes thereof and<br />
further to this article hee cannot depose./
To the 5th hee cannot depose, otherwise then as is conteyned in his<br />
foregoeing deposition./
To the 6th hee saith hee referreth him selfe to the Registrie of this Court<br />
and further cannot depose./
To the 7th hee saith that hee well knoweth that what damage is happened<br />
to the ''Exeter Marchant'' or her ladeing, and also what damage happened to the<br />
''Pilgrim'' by their being driven fowle one of an other and being driven on<br />
ground as aforesayd happened meerely through the rashnes and unadvisednes<br />
of the sayd Smith and his company in cutting or loosening the hawser of<br />
the ''Exeter Merchant'' as aforesayd and turneing her a drift, and hee saith hee<br />
verily beleeveth if the sayd Smith and his Company had not cut or loosened the sayd<br />
hawser the sayd damage had not happened And further hee cannot<br />
depose./
To the 8th hee cannot depose./
To the last hee saith his foregoeing deposition is true/
To the Crosse Interrogatories [CENTRE HEADING]
To the first hee saith hee was Masters Mate of the ''Exeter Merchant'' at<br />
the tyme Interrogate and further cannot answere/
To the second hee saith the premisses by him predeposed of in his deposition to the<br />
second and third articles were soe done in the day tyme and in the afternoone<br />
betweene two and six of the clock And further saving his foregoeing<br />
deposition hee cannot depose./
To the third Interrogatorie hee saith hee is 29 yeares of age or thereabouts and<br />
hath used the Sea for these fowerteene or fifteene yeares last past<br />
and thereby well knoweth and hath observed the customes by him<br />
predeposed of, and can safely depose touching them./
To the 4th hee saith that the tyme Interrogate the shipp ''ffrancis and Mary''<br />
laye at the Chayne Interrogate outward bound (as the sayd Smith her master<br />
told the Company of the ''Exeter Marchant'') and saith the sayd Smith was not then<br />
in the Act of receiving in any goods but told the sayd Company hee was<br />
tp receive goods aboard, whereupon the Company of the ''Exeter Marchant'' or<br />
