Touching the leakinesse}<br />
of the shipp the ''Patience'' and}<br />
the costs therein}
'''ffrederick Hoverling''' of Euchusen in North holland Mariner<br />
master of the said shipp the ''Patience'' aged 21 yeares or<br />
thereabouts sworne as in the acts of Court saith and<br />
deposeth as followeth, videlicet.
That the shipp the ''patience'' lieth in the shallowe water neere<br />
Saint Catherines, that every lowe water shee lies aground, and thereby the<br />
caskes wherein her alading of wines are, are at every lowe<br />
tidesoe strained and forced together that they leake exceedingly, and<br />
the shipp is much strained and damnified theerby, soe that shee is<br />
likely to be very leakie, and that unlesse the said wines beforthwith<br />
landed or taken out, they will be in greate danger to be quite<br />
lost and spoiled, and the shipp to be very much damnified.<br />
And soe leakie are the wines alreadie, that the pump runs almost<br />
with cleare wine.

Captaine of the shipp the ''handmayde'' aged twenty three yeares<br />
or thereabouts a witnes sworne and examined saith and<br />
deposeth as followeth videlicet./
To the first 2 and 3 articles of the saud allegation and schedule in the third article mentioned hee saith that hee this deponent<br />
was and is Captaine of the shipp Called the ''handmaide'' and soe hath bin for<br />
neere about two yeares last past and during such his being Captaine of her<br />
had a Commission under the seale of this Court to imploye the sayd shipp<br />
upon a warlike designe against the shipps and goods of the ffrench Kinge<br />
amd his subiects And saith that hee this deponent and his Company were at<br />
Sea upon the sayd warlike imployement in the moneth of September last past<br />
and being soe at se hee this deponent and Company with this sayd shipp the<br />
''handmayde'' did on or about the twentith day of the sayd Moneth of September<br />
last past by vertue of his sayd Commission surprize and take the arlate<br />
shipp called the ''Saint Jaques'' (a ffrench shipp and belonging as appeared to<br />
Grand Vills in ffrance) and possessed them selves thereof and of her<br />
ladeing And brought the same shipp ''Saint Jaques'' and ladeing togeather with<br />
her master and some of her company into Plymouth intending there to have<br />
caused them to be examined by vertue of a Commission from this Court to that<br />
effecte And saith that after the sayd shipp and ladeing was soe brought to Plymouth<br />
