Taylor Captaine of the ''Lizard ffrigatt'' in the imediate service of this Common<br />
wealth and that shee was by him carried into Kingsale in Ireland upon which notice<br />
the sayd Edward did ride over from Limbrick to Kingsale in the company of<br />
this deponent and his wife and there found the sayd shipp the ''Trooper'' brought in<br />
thither by the sayd Captaine Taylor with such part of her ladeing aforesayd<br />
taken in at Limbrick, on board her, as had not bin plundered and taken out<br />
of her by the sayd Brest men of warr and the sayd Captaine Tayler and his<br />
Company of the ''Lizard ffrigott'', And hee saith that after the sayd Edward Warr<br />
his coming to Kingsale hee the sayd Edward Warr and the sayd Captaine Tayler and his<br />
in the presence of this deponent had conference togateher touching the surrender and<br />
redelivereie of the sayd shipp ''Trooper'' and her lading and the sayd Edward<br />
Warr told the sayd Captaine Tayler that hee was informed by the sayd Ralphe<br />
Allerton the Master and John Burt the Merchant of the shipp ''Trooper'' and some others<br />
of her company that hee the sayd Captaine Tayler and his Company had taken<br />
out of the sayd shipp ''Trooper'' goods (part of her ladeing taken in at Limbrick<br />
as aforesayd) worth fower hundred pounds sterling and upwardsm and desyred<br />
the sayd Captaine Tayler that hee would make restitution thereof either to him<br />
the sayd Edward Warr, or leave them with the Commissioners for prize goods at<br />
Kingsale, and that soe doeing hee would in the behalfe of him selfe and the rest<br />
of the Owners aforesayd give and allowe to him the sayd Captaine Tayler or<br />
to the sayd Commissioners for prize goods for his use, so lnge for the sayd<br />
shipp ''Trooper'' and her ladeing according as the same should bee estimated and<br />
appraised by indifferent men, with which offer the sayd Captaine Tayler seemed<br />
to bee contented and promised to come againe to the sayd Mr Warr the next morning<br />
but contrarrie to such his promise hee saith the sayd Captaine Tayler, did in<br />
the night tyme before the next morning departe weith his sayd ffrigott<br />
the ''Lizard'' from KIngsale and carried with him therein all such goods and merchandzes<br />
belonging to the ''Trooper'' aforesayd as hee had taken out of her s(saving some part<br />
thereof which hee had sold in the Towne of Kingsale) which hee soe did as this<br />
deponent verily beleeveth out of a feare lest hee should bee called to<br />
Accompte by the Commissioners for prize Goods at Kingsale' in whose<br />
hands and possession hee had left the shipp ''Trooper'' and such goods as were<br />
left on board her unpillaged by him selfe or the Brest men of warr And<br />
further to these articles hee cannot depose./
To the 7th and 8th articles of the sayd allegation hee saith hee well<br />
knoweth that after the departure of the sayd Captaine Tayler with his ffrigott<br />
the ''Lizard'' from Kingsale aforesayd in manner predeposed the sayd Edward<br />
Warr did repaire to the Commissioners at Kingsale for prize goods<br />
and this deponent went alonge with him and well lnoweth that hee did from<br />
them procure a discharge of the arlate shipp ''Trooper'' and her ladeing left<br />
aboard her and gave caution to them to procure a discharge of the sayd shipp<br />
and her ladeing out of this Court or otherwise to be answerable to them<br />
the sayd Commissioners to that purpose, or to the like effect this hee the better<br />
knoweth for that hee writt the sayd bond and was ingaged and bound there as<br />
a suretie with the sayd Mr Warr for the true performance thereof which being<br />
soe done the sayd Mr Warr did in the behalfe of him selfe and the rest of the<br />
sayd Owners fitt and furnish the sayd shipp ''Trooper'' with such things as shee<br />
should neede of and procured a cocket from the Cistome house of Kingsale for<br />
