To the first article of the sayd allegatio … To the first article of the sayd allegation hee saith and deposeth tha the arlate<br />
Edward Warr Ralphe Wilson and Company videlicet William King Daniell Bowman Thomas<br />
holmes Bartholomew Rice and Patrick Creagh and others whose names this deponent remembreth<br />
not all subiects of this Commonwealth and all Inhabitants of Limbrick aforesayd except<br />
Patrick Creagh who lived and liveth also not farr from Limbrick aforesayd during all the tyme<br />
arlate were and are and ought to be true and lawfull Owners and Proprietors of the<br />
arlate shipp the ''Trooper'' of Limbrick (whereof the arlate Ralphe Allerton was Master)<br />
and of all her tackle apparrell and furniture and soe commonly reputed The premisses<br />
hee the better knoweth for that hee was resent when the persons above named and others<br />
of their Company bought the sayd shipp And further saving his sufficient deposition<br />
hee cannot depose./
To the second and third articles of the sayd allegation hee saith and deposeth that hee this<br />
deponent was and is a Merchant of Limbrick and was frequently Conversant the tyme<br />
arlate with the sayd Edward Warr Ralphe Wilson William King daniell Bowman<br />
Bartholomew Rice Patrick Creagh and others owners of the sayd shipp ''Trooper'' and<br />
knoweth that they did fitt and prepare the sayd shipp the ''Trooper'' in or about the moneth of Aprill last for a voyage to be<br />
made from LImbrick aforesayd to ffalmouth in England and thence to Saint Mallo's<br />
in ffrance if trade might there bee had with freedome and to returne for Limbrick<br />
aforesayd And saith the sayd Owners did in the behalfe of them selves and others of their<br />
Company cause to be laden aboard the sayd shipp un the sayd moneth of Aprill last<br />
as their owne proper goods and for their Accompts severall Merchandizes videlicet hides<br />
sugar brasse tallowe and other Commodities and did constitute and place<br />
aboard the sayd shipp as their Merchant or ffactor the arlate John Burt to<br />
proceede on the sayd voyage and dispose of the sayd goods and Merchandizes for their<br />
Accompt and with the proceede of them to relade the sayd shipp with such merchandizes<br />
as hee thought fitting and returne therewith to Limbrick, the premisses hee the better<br />
knoweth for that hee was present and sawe the sayd hydes sugar brasse tallowe and<br />
other Commodities laden on board the sayd shipp allsoe sawe and was present in the<br />
Custome house at Limbrick when the Owners aforesayd did enter into bond to the<br />
Customers there to pay the customes due for the sayd Merchandizes soe laden, and<br />
did likewise see a cockett under the seale of the sayd Custome house for all<br />
the goods before expressed given to the sayd Owners, who did in this deponents presence<br />
deliver the same to the sayd Ralphe Allerton whome they constituted Master of<br />
the sayd shipp for the sayd voyage and in this deponents presence ordered him<br />
in writeing, to goe with the sayd shipp to ffalmouth aforesayd, and from thence to Saint<br />
Malloes aforesayd if free trade might there bee had And for true and lawfull<br />
Owners and Proprietors of all the sayd goods and Merchandizes soe laden the sayd Edward<br />
Warr Ralphe Wilson and Company were commonly reputed And hee this deponent<br />
knoweth them soe to bee for that hee sawe them buy the sayd Marchandizes soe laden<br />
for their owne Accompts And further to these articles hee cannot depose/
To the 4th 5th and 6th articles of the sayd allegation hee saith and deposeth that<br />
hee this deponent liveth at Limbrick as aforesayd and knoweth that after the sayd shipp the<br />
''Trooper'' was soe laden with the goods and merchanizes aforesayd shee sett sayle from<br />
Limbrick aforesayd with the sayd John burt her Marchant and the sayd Ralphe Allerton<br />
her Master and his company intending to prosecute her sayd voyage according to the<br />
instructions aforesayd And hee saith that of his deponents knowledge about<br />
a weeke after the sayd shipps departure from Limbrick there came a letter<br />
to Limbrick directed to the sayd Mr Ware and Mr Bowman from the sayd John Burt<br />
Merchant with an other therein incloased from the Governour of the ffort at Kingsale<br />
in Ireland (which letters this deponent hath seene and read) wherein was expressed<br />
that the sayd shipp ''Trooper'' was about two dayes after her departure from<br />
Limbrick taken by two Brest men of warr videlicet the arlate Captaine dillon and<br />
Captaine Melldrum and that within lesse then forty howers after such her surprizall shee was<br />
