The claime of Cogia Jacomo, Cogia Saroukan)<br />
and Cogia Sefer Merchants of Armenia,)<br />
for their goods in the shipp the ''Saint Martin'' taken)<br />
by a Squadron of shipps commanded by Captaine)<br />
hall)
Examined upon an allegation given in on the<br />
behalfe of the said claimers.
'''Hojah Peter''' of the citie of Spaham<br />
in Persia, merchant aged 23 yeares or thereabouts<br />
sworne in Court and examined by the<br />
Interpretation of William Seaman and<br />
George Mascadonia Interpreters sworne in this<br />
behalfe.
To the first and second articles of the said allegation and to the bills of lading or<br />
schedules annexed, hee saith and deposeth that hee well knoweth all the parties<br />
producent and saith that the time arlate and before and in the time<br />
of her lading of all and singular the merchandizes mentioned and expressed in<br />
the three schedules annexed they were and at present are the true<br />
and lawfull owners and proprietors thereof and for such commonly accompted<br />
videlicet the said Cogia Jacomo owner of the goods and merchandizes mentioned in<br />
the first of the said schedules, Cogia Saronkon of those in the second<br />
and Cogia Safer of those mentioned in the third of the said schedules<br />
annexed, saving one Jacomo a servant to the said Safer oweth a bale of goods mentioned [XX] and saith that in the moneth of March last past, and more<br />
particularly about the tenth day of the same moneth (newe stile) they<br />
the said severall producents did at Smyrna lade aborde the shipp the ''Saint<br />
Martin'' arlate all the severall goods and [?merchandizes] in the said respective<br />
bills of lading for their owne respective accompts to be thence transported in<br />
the said vessell to Ligorne and there delivered unto them or their<br />
agents, or assignes for their use, all which hee knoweth because hee was present<br />
at Smyrna and sawe the said persons soe lade the said goods, where they<br />
after imbarked themselves to come with the same for Ligorne there to dispose<br />
them for their owne accompt. And otherwise hee cannot depose.
To the third article and bills of lading or three schedules annexed hee saith and<br />
deposeth that the said schedules were and are the true and originall bills of<br />
lading for the said goods and merchandizes, therein contained, and were<br />
and are signed and subscribed by and with the proper hand of Michael An[?dris]<br />
who at the time of the said subscription was Captaine and commander of<br />
the said shipp and in this deponents presence signed the same in the house of<br />
one monsieur dannian a Merchant living in Smyrna, and the contents<br />
of the said bills were and are as hee saith true, and were soe had and donne<br />
as therein is contained. And otherwise hee cannot depose.
To the fourth article hee saith that after the said lading of the said respective<br />
goods aboard the said shipp at Smyrna by the respective persons aforesaid<br />
they the said producents did depart therewith to looke to their said goods<br />
and tooke the said bills of lading along with them, and saith that in the<br />
said shipps course for Ligorne shee and her lading were met with<br />
surprized and taken by a Squadron of English shipps, in which<br />
Captaine hall was a commander, which hee knoweth because hee came<br />
alsoe in the said shipp the ''Saint Martin'' from Smyrna in company of the producents,<br />
and sawe the said seizure which was made about three weekes after Easter last off<br />
the Iland of Corsica, at which time the said producents were aboard her<br />
and had their said bills of lading in their custodie and possession, and<br />
kept them in their sh[??oues], and being turned ashore in the Ile of<br />
ffa[XXXXX]aa in Sicily, they thence brought them with them thither, this deponent<br />
comming in their company. And otherwise hee cannot depose.
To the fifth article hee saith and deposeth that the said<br />
Cogia Jacomo, Cogia Saroukan, and Cogia Safer were and are<br />
Merchants descended from Armenia, and doe use to trade betwixt Persia<br />
and Smyrna and alsoe from parts and places of the dominions of the Turkish<br />
Emperour to Smyrna aforesaid and from Smyrna to Ligorne, and doe<br />
use to trade and traffique in those quarters with the English<br />
and others andhold faire correspondence and commerce with them there<br />
which hee knoweth because hee alsoe tradeth in like manner in those places,<br />
and thereby hath observed the traffique of the said producents as aforesaid,<br />
