sworne the day above said befre the right worshipfull<br />
John Exton Doctor of lawes, one of the Judges<br />
of the high Court of the Admiraltie and<br />
examined upon Interrogatories ministred on the<br />
behalfe of the said Patrick Smarte sait as<br />
followeth by vertue of his oath.
To the first, second and third Interrogatories hee deposeth and saith<br />
that hee well knoweth the shipp interrate the ''Charitie'' of Lubecke<br />
whereof Simon Sosse was and is master, and saith that in her<br />
late course of proceeding betweene London and Dantzike, comming to<br />
sea about 14 leagues off Rotterdam about a moneth since shee was<br />
sett upon and pillaged by pyrates or sea Rovers in a small frigot<br />
commannded by an Englishman whose name hee knoweth not, and<br />
there were the and there taken out of her by the said pyrates<br />
or rovers and put aboard the said frigot and carried away seaven<br />
packs of goods, close and hard packed which were soe pillaged in his sight<br />
hee this deponent being then pilote of the said shipp and aboard her, and<br />
(as hee was informed by the said Symon Sosse the master, and beleeveth<br />
foure packs of the said goods belonged to the producent Patrick Smarte<br />
but what particular goods the said packs conteyned hee knoweth not, but beleeveth they<br />
were by the fashion of their packing fine goods, and afterwards this deponent<br />
was forcibly taken aboard the said frigot, and when hee was released and<br />
returned aboard the said shipp the ''Charitie'' hee sawe two emptie<br />
boxes that seemed to have binbroken up and as hee ws informed by the<br />
company aboard, the said pyrates had broke them open and taken<br />
gloves out of one of them and [?cloves] out of the other wherewith<br />
thy said they were before filled, and robed and carried them away.
