annorum aut circiter testis in hac parte productus iuratus et
examinatus./
Ad primum secondum et reliques arlos allegaciones ex [arte die Goreau et [?XXXX]
in hac parte dat et oblat, dicit et deponit That in and since the moneth of
Aprill last past and before the takeing of the arlate shipp called
the Salvadore of Hamborowe (whereof Harry Grell is master) he this deponent hath received mant
letters from the sayd Jaques Ribaud and Henry Bardett
whereby the sayd Ribaud and Bardett have often
advised him amongst other things that they were advised by a letter
which they received from Bastian Johnson of Lisbone dated the 27th
of March 1637 stile novo, that there was laden for their accompte by the sayd Johnson
abord the sayd shipp the Salvadore
fiftye chests of suger marked as in the margent of the schedule arlate
whereof twentye five chests were white sugers and the other
twenty five chests Muscavadoe sugers, alsoe that there was laden
for their accompte abord the shipp the Pellican of Hamborowe (whereof Claes Richter is master)
fiftye other chestes of white sugers, marked with the same marke, and
that he the sayd Johnson intended to lade twentye Canisters of
Synamon abord the sayd shipps the Salvadore and the Pellican, under
the same marke for their
accompte, and that he alsoe sayeth that he the sayd Johnson in reguard of the warrs betweene
Spayne and ffrance had consigned all the sayd sugers and sinammon
to be delivered to Gerard Vantonen and this deponent at Dover for the accompte of
the arlate John Goriou of London merchant, and the sayd Ribaud
and Bardett gave this deponent and hiis partner Gerard Vantonen order and
directions that assoone as the sayd goods came to their hands, they should
send them to Rochell unto them the sayd Ribaud and Bardett, And
he verily beleiveth in his conscience that the bills of ladinge
arlate were and are the true and originall bills for the goods therein
mentioned, but beleiveth that although it is expressed in the sayd bills
of ladinge, that the goods therein mentioned are for
the accompte of the sayd John Goriou, yet all the sayd goods
were reallye and trulye laden for the proper accompte of the sayd
Ribaud and Bardett and that the sayd Goriou had or hath noe
interest in them, which he is induced soe to beleive by reason of many
letters which he hath received from the sayd Ribaud and Bardett concerninge
the same goods, and for that he hath had correspondence with them
for these two yeares last past, and hath since the warrs betwixt
Spayne and ffrance received a great quantitye of goods and moneys
to the vallue of fourtye thousand pounds sterling and upwards, laden
abord severall shipps at Lisbone and other parts of Spayne and Portugall
and consigned to him this deponent and the foresayd Gerard Vantonen
which goods have bene expressed in the bills of
Ladinge to be for the accompte of Balthazar and John Martines
of Antwerpe, and the letters send with such goods have bene directed
to the sayd Balthazar and John Martines, and some of the gooods soe received
by him and his sayd partner have bene sayd in the bills of ladinge
to be for the accompte of the sayd John Gorriou, and yet all the
[?XXX] goods and moneys were really and truelye laden for the proper accompte of the
sayd Ribaud and Bardett and were sent unto the [?aforesayd] [?XXXXX] and other [?XXXXX] by this deponent
and his sayd partner, and that uppon all such letters sent in packetts to
this deponent and his sayd partner and directed to the sayd Balthazar and
John Martines
