and plundering to be above three thousand pounds
And further he cannot depose.
To the fifth article he deposeth and saith that he this deponent
being Agent for the producent did procure the Passe
arlate for the sayd ship from the Commissioners of the
Navy and Admiralty, and alsoe the Certificate arlate
from the Lord Mayor of London under the Citty seale
certifying the sayd shipp to belong unto the
producent, And he saith that since the seizure of the
said shipp he hath received advice by Letter from David
Billiard the Master of her that the said Passe and
the sayd Certificate, and alsoe the bill of sale of the
sayd shipp were all on board at the time she was
seized, and that they were taken away from aboard
her and detayned by the arlate heath and Company
And further he cannot depose.
To the last he saith his former deposition is true.
To the Interrogatoryes. [CENTRE HEADING]
To the first Interrogatory he answereth that he commeth to
be a wittnes at the request of Mr Philipps the
producent, that he hath noe share nor interest in either
shipp or lading and soe it wilbe neither profitt nor
preiudice unto him which way soever the cause goes, That
he hath knowne the said producent for some what
above 20ty yeares, and that he the Rendent and the
producent marryed two sisters, And further he cannot
answeare.
To the 2d Interrogatory he answereth that he never saw the
shipp interrate./
To the third Interrogatory he answereth that in his conscience he
beleiveth that the sayd shipp is absolutely the shipp of
the interrate Nicholas Philipps and of noe body else for that
he this Rendent hath found by the accounts concerning the
said shipp that he was sole Owner of her And further
he cannot answeare Saving that Zephaniah Parker
(of whom Nicholas Philipps the producent bought the
said shipp) told this Rendent that the said shipp cost
him the said Philipps about 800 li.
To the fourth Interrogatory he answereth that he doth
knowe the interrate Billiard, that he is a ffrenchman
borne (as he beleiveth) at Deipe in ffrance, that he
is and hath bin the pproducents factor there in
ffrance for about fifteene yeares and that he is
the factor there aswell of this Respondent as of divers
English Merchants of this deponents knowledge, And
further referring himselfe to his former
deposition he cannot answeare./
