To the 8th 9th and 10th Interrogatories hee saith his this deponents servant[?X GUTTER]
and the sayd [?Reppingale] were in the yeare 16423 seized upon and their boates,
by ffeversham ffishermen for fishing upon the grounds in question
and were all of them by order of the Lord of Waarwick released aforesayd, without paying anything to the ffeversham men And
further hee cannot answere saving hee saith that the schedule annexed
to these Interrogatories was subscribed sealed and delivered by this
deponent and the Interrogate John [?Reppingale] wherein they did oblige them
them selves that they would not for the future either by them selves or servants fish
in the grounds in question or to that eggect but for more
certaintie hee referreth him selfe to the condition of the bond or schedule Interrogated
soe by him subscribed and sealed
To the 11th hee saith hee cannot answere neither doth it concerne him to
answere thereto not having deposed touching any herrings or spratts nor
knowing of the takeing of any in the grounds in question./
To the last hee saith hee hath satisfied the contents thereof before soe farr
as hee cam./

Examined upon the said allegation

Gilbert Upton of London Merchant
aged 31 yeares or thereabouts sworne and examined.
To the first article hee saith and deposeth that hee well knoweth the
producent Richard Pistus and hath soe donne for theise three yeares last
or thereabouts, and was in the space well acquainted with him in
Cadiz and Saint Lucars, and saith hee is an Englishman, borne in the
West of England and a subiect of this Commonwealth and for
such commonly accompted and reputed, and saith hee this deponent
about five dayes since received a letter from his this deponents brother
Anthony Upton from Cadiz dated there the 26th of december last newe
stile, wherein hee amongest other things adviseth this deponent that the
said Richard Pistus is there committed to prison as being an Englishman
upon the late differences with the Spaniard, And otherwise hee cannot depose.
To the Interrogatories [CENTRE HEADING]
To the first hee conceiveth the said Richard Pistus to be of the age
of 35 yeares or thereabouts, and saith hee is a batchelourm and hath lived
in Cadiz about 3 yeares last, and before that in Saint Lucars, and otherwise
cannot answer saving as aforesaud.
To the second hee saith hee last sawe the said Richard Pistus at
Cadiz about 5 monethes since, And otherwise cannot answer.
To the third hee saith hee was borne at Luxton in devonshire, and
hath lived about 4 yeares and 3 quarters in Sevill and
foure monethes last in London, and before such his going to Sevill
hee lived in London about tenn yeares. And otherwise negatively.
