1. shee were before ˹of this deponents knowledge˺ a tight and stronge lighter yet shee was in very
2. great danger of sinkeing downe right in the River had not the carpenter
3. and some other of the Company of the Mary aforesayd presently came
4. aboard the lighter and helped to stopp her leakes with Oakham, and
5. Clay which they tooke off some barrells of new beere brought aboard
6. the Mary which not with standing this deponent and the sayd other labourers
7. wrought ˹about the XXeds XXX˺ almost up to the middle in water to heave out the rest of her ballest
8. into the mary thereby to lighten the sayd lighter and keepe her from
9. sinking, all which hee saith was occasioned by the willfullnesse of
10. the Company of the Thomasia and Alice in not lowering their sayles and
11. bearing southward as they were desyred, they habing tymely notice soo to
12. doe, and well hearing such notice as by their obstinate answere
13. aforesayd plainely appreared, and saith that the sayd shipp Thomasia
14. and Alice her Company ought having such tymely notice to have
15. taken care not to fall fowle of the sayd lighter and might easily have
16. avoided the same if they would habe endeavoured soo to doe, And
17. further to those a rticles hee cannot depose/
18. To the 6th hee saith hee well knoweth that imediately before the sayd
19. shipp Thomasia and Alice fell fowle of the sayd lighter the Ellen and SScne,
20. shee was a very strong and staunch lighter, and in deede had shee
21. not bin soe, shee bin without doubt sunke downe right by the
22. meanes aforesayd, And what the repaire of the dammage done her
23. rest hee knoweth not, but saith when she was repayered yet by
24. reason it doth appeare shee is patched and preserved hee beleeveth
25. shee will not yeild soe much by five pound sterling in the price
26. of her as shee would have done before the dammage receaved
27. And further hee cannot depose/
28. To the 7th ˹and 8th˺ hee saith hee referreth him selfe to the Registry of this
29. Court and further cannot depose
30. To the 9th he cannot depose/
31. To the 10th hee referreth him selfe to his foregoeing deposition and to the
32. lawe and further cannot depose./
33. To the last hee saith his foregoeing deposition is true/

35. To the first interrogatorie hee saith hee cometh to bee examined at the
36. request of the producent and hath receaved ˹of her˺ two shillings sixe pense
37. toward his ˹reindorance˺ losse of his labour by comming and attending to bee ˹sworne and˺ examined
38. and expecteth that the same shall bee made up two shillings a day beeing only
39. soo much as hee could earne by his ˹dayly˺ labour) for soo long tyme as hee shall
40. bee enforced to attend thereabout hee having all ready spent XXXX XXXX
41. fower dayes tyme thereabout and saith hee was one of the labourers aboard
42. the sayd lighter when the dammage happened and to the rest of the
43. interrogatories hee answereth negatively well knowing that the Thomasia and
44. Alice was not thrnst on by any other smack./
