John Biggs and Company owners of the shipp}
or Barke called the Blessing against a certayne shipp}
called the helpewell (whereof William Cooke is Master)}
and her tackle and furniture and against the sayd Cooke}
and alsoe against John Webb and Company comming}
in for their interest, and against all others}
comming in on their behalfe: Cheeke : Suckley}
Examined on a libell given in on the behalfe of
John Biggs and Company./

the Baptist in the Isle of Thanet Gentleman aged
47 yeares or thereabouts a witnes sworne
and examined saith and deposeth as followeth videlicet
To the first article of the sayd libell hee saith and deposeth that in the
Moneth of June last the arlate john Biggs was and went Master of the arlate
shipp the Blessing and had the Command of her as Master and saith the sayd
Biggs and Company were then commonly reputed the true and lawfull Owners
and proprietors of the sayd shipp the Blessing and of her tackle
apparrell and furniture as alsoe of a certayne boate belonging to her and for
such they the sayd Biggs and Company still are commonly accompted
the premisses hee deposeth for that hee is well acquainted with the sayd
Biggs and liveth in the same towne where hee liveth and soe hath done for
divers yeares last past and for that the sayd Biggs hath divers tymes within these twelve moneths last past as Master
and part Owner of the sayd vessell lett the same to freight to him this deponent
and others neighbours liveing neere this deponent and the sayd Biggs And further
hee cannot depose./
To the 2: 3: and 4th articles of the sayd libell hee saith that in the sayd moneth
of June last and on or about the nyneteenth day thereof the sayd Biggs and Company
were sayleing in the Blessing in the River of Thames laden with Corne and
were taken shorte by the tyde in Blackwall reach, by reason whereof
and alsoe for that the winde was then Contrary the sayd vessell the Blessing
came to an Anchor close under the weather shoare in the sayd Reach in
a very convenient place for such a smale vessell as shee is to anchor in, and
a place very probable for avoideing any occasion of damage by any shipps coming
fowle of her, where shee intended to ride at Anchor till either a faire winde
happened or the tyde returned to beare her up to London All which tyme of the
Blessings casting Anchor the arlate shipp the helpewell was at a
great distance from the Blessing soe that the Company of the helpewell
had space sufficient to have borne up and kept cleare of the Blessing and
have avoided dalling fowle of her if they had pleased and endeavoured
soe to doe, and might have passed by her without doeing her any damage as well as a shipp which came by her
a little before the helpewell, and another which came a little after the helpewell
did of this deponents sight and knowledge, which notwithstanding and although
tyhe Master and Company of the Blessing perceiveing the helpewell to
come directly towards them did earnestly and with a loude voice call out to
the Company of the helpewell to beare up and passe cleere and
not fall fowle on their shipp the Blessing yet the sayd helpewells Company
kept on their course and fell fowle of the Blessing and brake her sterne
