Transcription

Oileman in this citie and hath dealt for himselfe as a freeman
in that trade for theise fourteene yeares last or thereabouts, and in that
space hee hath bought severall parcells of sweete oiles and hath had deliverie
thereof made at and after the gage of 252 gallons to the tonne, and that
in particular hee within this fortnight last bought a parcell of
120 pipes of sweete oiles of one Mr Wool[?fras], relating to mr Nathan
Wright, and is by contract to have 252 gallons delivered to the tonne.
And otherwise referring him selfe to the lawe of the land he cannot
depose.

To the third hee referreth himselfe to the Statutes and lawes of the
land, And otherwise saving as aforesaid hee cannot depose.

To the fourth hee saith that about a yeare since
there was a triall at Guildhall betweene [?XXXXXXXgood] and
Mr Brewer about the gage of sweete oiles, and as hee heard, the
Jury gave up their verdict for 252 gallons of sweete oiles to the
tonne. And otherwise hee referrs himselfe to the Records of the
Court about that triall. And cannot further depose.

To the 5th hee saith that the usuall and ordinary gage of sweete
oiles by the citie gager is 252 gallons to the tonne, and that the
said Gager cannot legally gage sweete oiles at a lesse gage then
252 gallons to the tonne, being bound to gage after that gage.

To the Interrogatories. [CENTRE HEADING]

To the first hee saith hee keepeth an oile shopp upon ffish streete
hill, and otherwise negatively saving his foregoeing deposition whereunto
hee referreth himselfe.

To the second hee saith hee was present (to his remembrance) at the
prize office on the day wherein the oiles in
question were bought and this deponent for his part did not then thinke or
understand that there would be deliverie made of those oiles at
a greater gage than 236 gallons to the tonne, and this deponent
saith that the usuall rate and gage of sweete oiles at the prize
office at London hath bin 236 gallons to the tonne, and hee for his
part hath bought there severall times and never had more then 236 gallons to the tonne. And otherwise hee cannot depose
saving as aforesaid.

To the third hee cannot depose.

To the fourth hee saith that within theise two yeares last hee hath
knowne many parcells of sweete oiles bought and sold here
in London and deliverie made at 236 gallons to the tonne that being
the usuall and ordinary gage in buying and selling in London unlesse
a greater gage be contracted for, yet hee hath knowne 252 gallons
delivered to the tonne though there hath in the bargaine bin
noe mention made of the number of gallons taht should be
delivered. And saith the bills of prizes currant given out
by Mr John day have as hee hath heard for some yeares past mentioned 236 gallons
to the tonne of sweete oiles. And otherwise hee cannot depose saving
as aforesaid./.
