hee this deponent well knoweth to be true, for that hee this deponent was
and is the arlate John Claessen who was Master of the said shipp as
aforesaid, and in that quality was privy to and acting in the [?transaction GUTTER]
by him predeposed. And further cannot depose./

To the 3. hee saith, That the arlate shipp the Saint John Baptist
arrived in safety with her said Cargazoon at Bayon in france
where the same according to the Owners discretion were delivered to
Reynard Bogart ffactor of the said Arnold and Elias Beake
and Companie whol sold and disposed the same, and with the
proceed of the said outwards Cargazoon the said ffactor bought and
provided the lading of wyne resin and other Merchandizes in
Controversie seized by the said Major Sedgwick and others, and saith
That upon the said shipp and ladings departure from Bayon, the said
ffactor gave this deponent order to Conduct the same into the downes, and
there to attend receive and follow the Order of the said Arnold
and Elias Beake and Companie. hee also further saith, That the
said Arnold Beale one of the Owners aforesaid fearing the seizure
of the said shipp and lading by the dutch, sent over letters of advise both
to this deponent and to their said factor importing and ordering them for
the better security of the said shipp and lading there to make and
contrive a Colourable Charterparty between this deponent and one
William de Labistrate a Merchant of hamburgh, as if hee
the said Labistrate had freighted the said shipp for hamburgh
for his owne accompt, and that a bill of ladeing should be made
to that effect, that so the said shipp and lading might the better
gett cleare of the dutch in Case of rencounter, which Colourable
Charterpartie and bill of lading were accordingly made, but saith
That in trueth and realitie the said Vessell and lading were onely
designed for the downes as is predeposed, and were not at all to
goe for hamborough nor consigned or any way appertaining to the
said Labistrate nor had he any manner of intention therein, nor
was at all concderned in the same, otherwise then that his name was
colourably and fictitiously made use of by the order and to the end and intent before
expressed. The premisses hee declareth to be true of his certaine
knowledge being as aforesaid Master of the said shipp and during
all the transactions aforesaid, and acting and privie in and to
the same. And further cannot depose./
