and ladeing off Montrosse on the Coast of Scotland as the Company
of the said Scotts man was carrying her along for Abderdene, her master
and Company being dispossed and dispoyled of the posssession and Comand of
her, and only this deponent and his Contest John Holdwicke and a boy
of the Company left in her, and six of the Scottsmans Company being
aboard her when she[?e] was rescued, so that the sayd Boyer and ladeing had
bin lost to the Owners if the said rescue had not bin made only the Scotsman told the
said Skipper before hee carryed him out of the said Boyer that hee would have the same againe and his freight
but the ladeing should bee made prize because it was bound for London./
To the 7th hee saith that it was about 9 of the clocke in the morneing of the said
30th of Aprill that the said Scotchman tooke them, and about 6 in the morning
of the 5th of May last that the Assistance rescued them.
To the 8. 9. and 10th hee answearth negatively saveing as aforesaid./
To the 13th hee saith hee was not a wittness to the bill of sale interrogated
And further saith that as he hath heard the said Boyer was built
above 20 yeares since att Serdam in Holland by [?at] [?for] Peter Johnson Catt of
Hamborowe And that the Interrogated Abraham Stockman and Company have since
bought the same/

The day above said upon the said Allegation./

John Holdewicke of Breame in
Germany Sailer aged 22 yeares or thereabouts sworne and Exammined
To the first article of the said Allegation hee saith and deposeth that within and for
all the time arlate the producents Abraham Stockman david Vandermar[XXX]
and Otto Papa the Skipper of the said Boyer (whome hee well knoweth) and
others dwelling in Hamborowe whose names hee remembreth not were and are
the lawfull owners and Proprietors of the said Boyer the Dove, and of her
tackle apparell and furniture, and for such comonly accompted which hee
knoweth being one of the said Shipps Company and acquainted with theire
setting her out as Owners And otherwise hee cannot depose./
To the 2. and 3d articles hee saith and deposeth that within the time arlate and
more particularly in or about the Moneth of Aprill last the said Boyer the
Dove of Hamborough[?t] (Otto Papa Master) was laden with wheate at Hamborow
and sent out, by the said Stockman to saile for this Port of London to deliver the said wheate to the use
and Accompt of Mr Lucas Jacobs Merchant of London and company, which hee
knoweth being one of the Company of the said Boyer and seeing the said wheate laden and for the reasons aforesaid
And hee further saith that within the said time and after the aldeing thereof
the said Skipper and Company sett saile and departed with the said vessell or Boyer
from Hamborowe intending to bring her for London with her said ladeing But in her
Course comeing off thye English Coast betwixt Alfernes and Yarmouth shee was
mett with all by a Scotts man of warr and by him seased on or about the 30th day of Aprill last
upon which seisure the said Skipper of the Boyer and three others of his Company
were taken out of her into the said Man of Warr and carryed away in her, which
hee knoweth because hee was aboard the said Boyer and one of the Company thereof
and saw the premisses so done But about five dayes after the said seisure and
before the said man of warr had brought the said Bowyer and ladeing into any
Port of Harbor the said [?Boyer] and ladeing of wheate were mett with and retaken
or rescued by the Assistanse ffrygott comanded by Captaine Bourne in the imediate
service
