The personall answers of
Samuell Bart merchant made to
the pretended articles of a certaine
pretnsed allegation given and administred
against him on the behalfe of Peter
Vandeputt and others
To the first position of the said pretensed allegation
this respondent answereth and beleeveth the
same to bee true.
To the second pretensed position this rendent
answereth and referreth himselfe to the
Charterparty signed and sealed by this
rendent what he beleiveth to bee true
and otherwise hee doth not beleeve the same
to bee true in any parte.
To the third pretensed position, This rendent
answereth and beleeveth that about the
time arlate the arlate shippe the Seahorse
did depart from this port of London with
such goods wares and merchandizes as this
rendent had laded, or caused to bee laden
aboard her, and safely arrived therewith att
the Canary Island and did there deliver them
to the factor of this rendent, and did alsoe
take on board the said shipp the Seahorse att
the Canary Islands twenty two pipe, [?and ?1/2 ?XXX]
Canaries for the account of this rendent and
noe more whereas in case the arlate
Captaine Ashmore had performed the
Charterparty arlate and had staied the full
forty workeinge daies and 10 dayes demorage
accordinge to the said Charterparty this
rendent or his factor in the Canaries
might and would have laden 24 pipes of
Canary wines more then he did which wines
this rendents factor was constrained to leave
behind
