Transcription

To the Interrogatories [CENTRE HEADING]

To the first hee saith that hee comethto bee a wittnes in this cause
att the request of Sir Jacob Garrett the producent, And saith if it were in his
power hee would give the victory to them that had the right thereto,
And further negatively./

To the second hee saith hee shall receive no advantage, neither sustaine
any losse, whether of the said parties prevaile otherwise negatively

To the third hee saith hee knoweth not

To the 4th hee saith hee resided att Ligorne about 4 yeares together
and was servant to the Interrogated John ffarefax, unto who and company the said 27
barrells of Indico were consigned and did come [?for] the producent Sir Jacob
Garrett, to bee sould for the best advantage, as many other goods in the like
case have beene to a greate vallue And hath seene orders to that purpose And
otherwise referring himself to his [XXXX] depositions hee cannot answer./

To the 4th he answereth that the Interrogated John ffairefax was gone from
Lygorne about 5 Monthes before the said Indico was laden aboard the Salvadore
And hee saith that hee saw a recipt (under the Boatswaines hand belonging to
the said shipp) of 20 barrells of Indico (amongst other Goods which
expressed that the said Indico was laden by the interrogated Martin Lister And further
hee knoweth not.

To the 6th he saith that of his sight and knowledge there was many other
Goods of the said Listers and Company or Partners carryed to divers Boates
in the say time which were afterwards (for ought he knoweth) laden on
board the shipp the Salvadore in the day time, and not in the night as hee over heard of, And
further knoweth not.

To the 7th Interrogatorie hee saith that he received a letter (open) from the Interrogated
Lister which was by this rendent read to the Master of the same shipp the
Salvadore, and therein the said letter gave the Master directions to followe this
rendents order, And he saith that his order (from the said Lister) was
to saile with the said Goods and Indico to Civita Vechia
And otherwise hee answereth negatively, and saveing his foresaid depositions
to which hee refreth himself

To the 8th he saith that he was absent about 12 weekes from
his said Mr ffarefax, and some few dayes after his returne, he was
sent away with the Goods as aforesaid And so knoweth not of any orders betweene
the producent Sir Jacob Garrett or the said Lister ffairefax and Company other
then as is predeposed, to which hee referreth himself, and otherwise he saith
he cannot answere./

To the first Interrogatorie he saith that he hath heard and verily beleeveth that
the said Captaine Terrick and Captaine Swanley and theire Companys did deliver
or pay out the said Martin Lister and Company the summe of 3000 dollers for
which (he also beleeveth) they received bills of Exchange to be payd in London,
And otherwise he knoweth not/
