Transcription

Then appeared the said Isaac Phillipps one
of the parties therein mentioned in whose presence the said Sdvocate
alleadged that the said Phillips did Contract with the Commissioners
for prize goods for the number of 40 dozen of Looking glasses
at 24 s a dozen and produced the originall Contract in writinge
under the hand of the said Phillips wherein it is expressed
that he bought the number of 40 dozen of Looking glasses
more or lesse at the arate of 24 s a dozen which contracte the
said Phillips did acknowledge to have made the said
contracte and that the same is by him subscribed and hee
alleadged that hee tendred the money for the same to the
Commissioners for prize Goods who refused to refused (sic) to receive the
same which allegation the Judges at his petition admitted and
the same beinge admitted and repeated and the said
Advocate not beleevinge the same the Judges assigned the
said Phillips to proove the same upon tuesday next and at the
petition of Mr Smith in the presence of the said Advocate
appearinge for the said John Brewer the Judges did
decree an attachment against the said Brewer in case he
shall not appeare upon Munday next and shew cause why
hee should not pay the money due from him for the goods
by him bought of the said Comissioners and did decree the rest
of the said parties who did not appeare to be attached et cetera

of the said Withers in not givinge his
fuller answeare to the allegation given and
admitted against him accordinge to the monition of
this Court in that behalfe made pronounced him

attached untill hee shall give a fuller answeare to
the said allegation./.
