1. Virginia hogsheads to be brought from there is commonly accounted to
2. bee one and the same and further to this article hee cannot depose/
3. To the 11th and 14th articles of the sayd allegation hee saith that hee was not
4. at Virginia at the sayd Alexander arlate was there upon the voyage in question
5. And therefore cannot positively of this knowledge depose anything to the conteath
6. of these articles but saith that by letters from his commanders in Virginia
7. he hath bin advised that at the tyme the Alexander laye in yorke River
8. in Virginia the voyage in question there were divers hogsheads of
9. tobacco tendered by this deponent correspondants there to have bin
10. laden on board the Alexander but were these sed to bee taken on board
11. the sayd shipp unlesse this deponents correspondants would have
12. given fourty shillings or upwards pounds in a tonne ˹more˺ than hee this deponent
13. hath agreed with the arlate Mr Armiger Warner to bring them for,
14. whereupon the sayd tobaccoes were shipped afterwards upon the providence
15. of London Captaine Swanzy, Commander who bought there to this
16. And further to these arles hee cannot depose saving hee saith hee
17. hath heard and beleeveth that the Alexander might have had more tobaccoe
18. laden aboard her in Virginia then shee brought from thence the
19. voyage in question./

24. To the first hee saith hee was not required by Mr Brown the deputy marshall
25. of this Court on behalfe of the producent Warner to appear and
26. testifie the truth of his knowelde in this case and saith there is some
27. diferences and XXXX large in matters of Account in merrchandizing
28. affayees betwixt this rendent and the sayd Warner and asaile depending
29. thereupon, wherein hee beleeveth the sayd Warner will appeare to bee
30. indebted to this rendent but in how much this deponent at present knowe
31. not, and saith it will bee neither profit nor prejudice to this deponent
32. whether Warner presaile or be overthrowne in this case hee ˹hicks˺ being
33. noe way concerned therin and saith hee is noe way of kinn or allyance
34. to the sayd Warner and further cannot answere otherwise than
35. negatively./
36. To the 2 hee saith hee never sawe the shipp Alexander interrogate
37. that hee knoweth of, and was not at Virginia when shee was last
38. there, And further saving his foregoing deposition to which hee
39. theforreth hee cannot depose saving hee saith the goods predeposed of
40. tendered by his correspondents to be laden aboard the Alexander were
41. this here deponent consigned to this rendent but were properly the goods
42. of one ffrancis fonds then a widdowe in Virgina, and were marked
43. with the marke in the margent./
