1. being the summe of fourtie shillings, which hee expecteth whether mr
2. drinkewater be overthrowne or not, and doth not expect expecteth any
3. benefit by his being overthrowne this XXX,

7. Exámined upon the foresaid allegation.

9. Nathaniel Hutchinson of the parish of Saint Olaves Southwarke
10. Mariner. aged 59 yeares or thereabouts sworne and examined.
11. To the first article of the said allegation hee saith and deposeth that the
12. voyage in question for which the freight is demanded by mr Ash and other
13. the owners of the said shipp the Jonas, there were not any herrings
14. received or laden aboard her at Dublin, but such as were sent aboard
15. from or by the order of the arlate Nathaniel drinkewater and
16. Samuel Weston, and were brought aboard by their agents or directions,
17. which hee knoweth because hee this deponent at such time as the
18. said shipp there received in her lading, was master of her, (Richard
19. Wiltshire who went out master of her having died; and X having ˹had˺ received
20. order from them ˹not˺ to receive none but such goods herrings of any other
21. but only such herrings or goods as they sent or caused to be sent aboard,
22. and the said order was as hee saith observed by this deponent and
23. company accordingly, by which being tied up, the said shipp came an
24. hundred tonnes dead freighted thense, And saith hee the said
25. Weston cleared the said shipp XXX and lading at the Customehouse
26. in dublin, and saith hee this deponent then master of the said shipp
27. did not receive any herrings, what soever by any contract with mr
28. Vanderouter or mr Johnson, or any other on their behalfe, but all
29. herrings that hee ˹or his company˺ received, were ˹soe˺ received as sent aboard by and
30. or from the said drinkewater and Weston or one of them or their orders.
31. And otherwise hee cannot depose.
32. To the second hee saith that there were not above three barrells
33. of herrings at the most ˹laden or˺ brought home in the said shipp for this
34. deponents company or any of them, and for his owne part hee
35. laded not nor brought any for his owne account.

38. To the first Interrogatorie hee saith hee was ˹never˺ noe any part owner of the said
39. shipp, but was master of her as aforesaid upon the death of wiltshire
40. and as master signed, sealed and for his act and deed delivered the
41. Charterpartie or bill of or schedule annexed (nowe shewed unto him),
42. and the saith the same is the originall Charterpartie for the matters
43. therein contained and for the voyage in question wherein the freight
44. in question is demanded, and ˹is˺ his owne act and deede, and that
45. hee is the same person that soe signed sealed and delivered the same
46. which was donne on or about the day of the date thereof. And otherwise
47. hee cannot depose saving as aforesaid.
